Ratification, acceptance, approval or act of formal confirmation.
If formulated when signing a treaty subject to ratification, act of formal confirmation, acceptance or approval, a reservation must be formally confirmed by the reserving State or international organization when expressing its consent to be bound by the treaty.
In consequence, on 21 December 1998 the Secretary-General deposited on behalf of the United Nations an act of formal confirmation of the Convention.
Authorizes the Secretary-General to deposit, on behalf of the United Nations, an act of formal confirmation of the Vienna Convention on the Law of Treaties between States and International Organizations or between International Organizations, as provided in article 83 of the Convention;
The 1986 Convention adds that an international organization can make a reservation when it expresses its consent to be bound by a treaty by an act of formal confirmation.
None of the signatory organizations had deposited an act of formal confirmation of the Convention by 21 August 1997.
Depositing an instrument relating to an act of formal confirmation or an instrument of accession, this Convention shall enter into force on the ninetieth day after such deposit, or at the date the Convention enters into force pursuant to paragraph l of this article, whichever is later.
Member States may thus wish to consider whether it would be timely for the United Nations to deposit an act of formal confirmation of said instrument.
In accordance with General Assembly resolution 53/100, on 21 December 1998, the Secretary-General deposited an act of formal confirmation of the 1986 Vienna Convention on the Law of Treaties between States and International Organizations or between International Organizations.
In particular, he referred to the deposit on 21 December 1998 by the Secretary-General, on behalf of the United Nations, of an act of formal confirmation of the Convention.
If a conditional interpretative declaration is formulated when signing a treaty subject to ratification, act of formal confirmation, acceptance or approval, it must be formally confirmed by the declaring State or international organization when expressing its consent to be bound by the treaty.
The reserving State has simply renounced it after the time for reflection has elapsed between the date of signing andthe date of ratification, act of formal confirmation, acceptance or approval.
That resolution also encouraged international organizations that have signed the Convention to deposit an act of formal confirmation of the Convention, and other international organizations entitled to do so to acceed to it at an early date.
IMO reported that the resolution was to be drawn to the attention of the IMO Council, which was scheduled to meet from 14 to 18 June 1999, so as to decide on the formal participation of IMO in the1986 Vienna Convention and to authorize the Secretary-General to deposit on behalf of IMO an act of formal confirmation of that Convention.
Where the United Nations intends to undertake a treaty action for which purpose full powers, an act of formal confirmation or an instrument of acceptance, approval or accession are required, the relevant department, office or regional commission shall consult with the Office of Legal Affairs in advance of such action.
The consent of an international organization to be bound by a treaty may be expressed by signature,exchange of instruments constituting a treaty, act of formal confirmation, acceptance, approval or accession, or by any other means if so agreed”.
For each regional economic integration organization referred to in article 26, subparagraph(c) depositing an instrument relating to an act of formal confirmation or an instrument of accession, this Convention shall enter into force on the ninetieth day after such deposit, or at the date the Convention enters into force pursuant to paragraph l of this article, whichever is later.
The text of article 23, paragraph 2, of the Vienna Convention of 1986,which requires the confirmation of reservations made when signing if they have been formulated"subject to ratification, act of formal confirmation, acceptance or approval", is reprinted above para. 231.
If formulated when negotiating, adopting or authenticating the text of the treaty orwhen signing the treaty subject to ratification, an act of formal confirmation, acceptance or approval, a conditional interpretative declaration must be formally confirmed by the reserving State or international organization when expressing its consent to be bound by the treaty.
It might be thought, however, that the number of cases to which article 23, paragraph 2,seems to limit the possibility of subordinating definitive consent to be bound(ratification, act of formal confirmation, acceptance or approval) is too small and does not correspond to the one in article 11.

He noted with interest the suggestion made by the Secretary-General in paragraph 3 of document A/52/363 that Member States should consider whether it would be timely for the United Nations to deposit an act of formal confirmation of the 1986 Vienna Convention on the Law of Treaties between States and International Organizations or between International Organizations, and concurred with the Secretary-General's view that such confirmation would promote the entry into force of the Convention.

The instruments of ratification, acceptance orapproval and those relating to acts of formal confirmation shall be deposited with the Secretary-General.
With regard to the deposition of acts of formal confirmation(para. 5), the Working Group had agreed to look into the question during the current session.
