Hazardous waste is defined in the Convention as"wastes that belong to any category contained in Annex I, unless they do not possess any of the characteristics contained in Annex III;(definition in article 1, paragraph 1(a)) and wastes that are not covered under paragraph 1(a) but are defined as, or considered to be,hazardous wastes by the domestic legislation of the party of export, import or transit" definition in article 1, paragraph 1b.
In conclusion, on the basis of the two aforementioned Acts as well as prior legislation in this area,the Swiss Government has issued no permits for the export, import or transit of weapons or military equipment relating to Somalia since 1992.
As stated in Article 1, paragraph 1(b),"Wastes that are not covered under paragraph(a) but are defined as, or are considered to be,hazardous wastes by the domestic legislation of the Party of export, import or transit" are also subject to the Basel Convention.
Only companies that possess an export licence for weapons and ammunition issued by the Police Department under the Ministry of Interior of the Republic of Lithuania or have obtained single permits for every individual export, import or transit operation may export,import or transport in transit weapons or ammunition of Category B, C and D.
