Let me take this opportunity to congratulate him warmly on his election to the presidency of the Court andpay tribute to the valuable efforts of his predecessor, Judge Higgins.
As Judge Higgins stated, that has made it possible to ensure that States obtain justice without unreasonable delay.
Also participating in one session were the following Judges of the International Court of Justice: Judge Ranjeva(Madagascar), Judge Herczegh(Hungary), Judge Fleischhauer(Germany),Judge Koroma(Sierra Leone), Judge Higgins(United Kingdom),Judge Rezek(Brazil), Judge Elaraby(Egypt), and Ad-Hoc Judge Frank USA.
While in New York, Judge Higgins addressed a meeting of legal advisers of Ministries of Foreign Affairs on 29 October 2007.
Judge Higgins has reminded us of the many cases that the Court has examined and the judgments and opinions issued since it was created.
Within the period under review, Judge Higgins added, the Court had also made an order on provisional measures and had held hearings in three cases.
Judge Higgins, in a recently published article, emphasized the need to keep the legal minds of the international judicial bodies informed of one another's achievements.
We also thank their predecessors, Judge Higgins and Judge Al-Khasawneh, for their esteemed leadership of the Court over the last three years.
As Judge Higgins has reported, however, the Court will have the advantage that it has effectively cleared its backlog of hearings.
On 22 June 2006 the President of the Court, Judge Higgins, made a speech in the course of the public debate organized by the Security Council on the theme,"Strengthening International Law.
Judge Higgins also made official visits to Morocco in connection with the fiftieth anniversary of the Supreme Court, and to the United Arab Emirates, where she gave a number of lectures.
I would also like to convey to Judge Higgins my Government's recognition of the invaluable work done by all the judges of the International Court.
As Judge Higgins pertinently pointed out during the Security Council's thematic debate on the strengthening of international law, on 22 June,"strengthening international law" means"the widening and deepening of the content of international law, and… the fortifying of the mechanisms for securing compliance with or enforcement of international law" S/PV.5474, p. 5.
The following week, Judge Higgins gave a series of lectures in Japan, inter alia at the United Nations University and the Universities of Kyoto and Hiroshima.
We commend Judge Higgins for her dedicated stewardship of the Court and for the Court's impressive achievements over the period under review.
We thank Judge Higgins for her introduction of the report of the Court contained in document A/63/4, detailing the work accomplished by the Court over the past year.
While in New York, Judge Higgins also addressed the AsianAfrican Legal Consultative Organization on 20 October 2006, and delivered a speech on 23 October 2006 to the meeting of Legal Advisers of Ministries of Foreign Affairs.
During the period covered by this Report,the President of the Court, Judge Higgins, delivered a speech at the formal ceremony marking the fortieth anniversary of the T.M.C. Asser Institute in The Hague, as well as a speech at the ceremony for the tenth anniversary of the International Tribunal for the Law of the Sea(ITLOS) in Hamburg.
On 1 November 2007, the President of the Court, Judge Higgins, addressed the General Assembly at the 42nd plenary meeting of its sixty-second session, on the occasion of the presentation of the Court's annual report. On 2 November 2007, she also addressed the Sixth Committee of the General Assembly and was invited to speak before the Security Council during a private meeting.
As this happens to be the last time that Judge Higgins may be addressing the General Assembly in her capacity as President and Judge of the International Court of Justice, my delegation wishes to place on record Ghana's deep appreciation for Judge Higgins' distinguished contribution to the renaissance in the working methods of the Court, thus helping to lift the image of the Court as an indispensable judicial organ for the peaceful settlement of international disputes.
Judges Higgins, Kooijmans and Elaraby and Judge ad hoc Kreća appended separate opinions.
In their joint separate opinion, Judges Higgins, Kooijmans and Buergenthal noted that the immunity of the head of State was traditionally predicated on status, on the basis that he was seen as personifying the sovereign State and found"no basis for the argument that Ministers for Foreign Affairs are entitled to the same immunities as Heads of State.
