The group also started to discuss in a more integrated manner issues related to the management of HFCs, processes to address them and options to establish a relationship between the UNFCCC and the Montreal Protocol in further detail.
Developing a leapfrog approach forArticle 5 parties and a leadership approach for nonArticle 5 parties to address the management of HFCs;
The potential need for a decision under UNFCCC to address the management of HFCs using the Montreal Protocol and its mechanisms and the need for assurance of new and additional funding form Article 2 parties;
Another representative stated that he wanted to make it clear that the discussion group had discussed issues relating only to the management of HFCs, and not to the proposed amendments to the Protocol.
On a framework for a financial mechanism for the management of HFCs, it was noted that the financial mechanism of the Montreal Protocol had been effective in providing technical and financial assistance for Article 5 parties in phasing out ozone-depleting substances.
Requesting the Secretariat to compile information related to the scope of the Vienna Convention andthe Montreal Protocol relevant to the management of HFCs under the Protocol;
Another view expressed was that the legal basis andthe rationale were provided in Article 2 of the Vienna Convention, since the management of HFCs would address environmental problems related to specific substances developed to replace ozone-depleting substances;
Questions and issues related to the availability of alternatives, especially for the RAC sectors andthe need to have definitive solutions for sectors before the management of HFCs can be addressed;
The Working Group had established a discussion group to tackle issues relating to the management of HFCs, including the financial, technical and legal aspects, and the appropriate processes to deal with them, including options for establishing a mechanism to deal with the linkage between the Protocol and the United Nations Framework Convention on Climate Change.
Before starting the discussions,the co-chairs clarified that the mandate provided by the Meeting of the Parties was to continue the deliberations of the discussion group on issues pertaining to the management of HFCs using the Montreal Protocol and its mechanisms.
Some representatives had expressed concern about the interaction between HCFC phase-out and the management of HFCs, saying that there were cost implications of moving away from HCFCs, as well as possible adverse effects on energy efficiency, and asking about the impact that imported equipment could have on phase-out or phase-down activities.
One view expressed was that in order to address HFCs under the Montreal Protocol, the Montreal Protocol and the Vienna Convention, including its title and its scope,should be amended to provide a legal basis for the management of HFCs under the Montreal Protocol.
Options suggested were to organize a joint meeting between the two regimes to address the legal issues related to the management of HFCs, as well as to request the Ozone Secretariat and the climate change secretariat to provide a legal opinion on the legal aspects of phasing down HFCs under the Montreal Protocol, as well as on issues related to funding mechanisms and flexibility;
After further discussion, the parties agreed to conduct informal discussions on mechanisms for the sustainable phase-out of HCFCs in Article 5 parties,as well as all issues related to the management of HFCs in all parties, and how to address HFC management in 2015.
It was also suggested that the management of HFCs under the Montreal Protocol might not take advantage of principles applicable under the climate change regime, including on the principle of"common but differentiated responsibilities" and the principle of"respective capabilities", or the flexibility provided under the climate regime, which allows for addressing a basket of gases;
Another option suggested was to request the Ozone Secretariat to compile the relevant provisions of the Montreal Protocol andthe Vienna Convention as the basis for a textbased discussion with a view to better understanding the legal texts relevant to the management of HFCs.
After a protracted discussion, the Working Group agreed that interested parties would hold an informal discussion on the management of HFCs, including the legal and technical issues raised at previous meetings and during the HFC management workshop, and develop options for addressing the issues raised, including the relationship between the Montreal Protocol and the United Nations Framework Convention on Climate Change and its Kyoto Protocol.
The decision by the parties to hold the workshop was reached in the light of the discussions of the Open-ended Working Group at its thirty-third meeting andthe Twenty-Fifth Meeting of the Parties on the broad issues concerning the management of HFCs using the Montreal Protocol and its mechanisms.
In the light of the discussion above, the Working Group agreed that interested parties would hold an informal discussion, facilitated by Ms. Gudi Alkemade(Netherlands) andMr. Obed Meringo Baloyi(South Africa), on the management of HFCs, including the legal and technical issues raised at previous meetings and during the HFC management workshop, and develop options for addressing the issues raised, including the relationship between the Montreal Protocol and the Framework Convention on Climate Change and its Kyoto Protocol.
