As set out in the section above concerning Somalia,each proposed transfer under these arrangements requires a request to be made by the Seychelles authorities and the agreement of the relevant Somali authorities.

In the event of a decision that United Nations-selected judges or prosecutors should participate in these courts, the Secretary-General would require amandate from the Security Council to negotiate an agreement to this effect with the Transitional Federal Government, in consultation with the relevant Somali regional authorities.
The Transitional Federal Government and the relevant Somali authorities would need to consider whether relocating such a court in a third State would raise issues of compatibility with the provisions of the 1960 Constitution and the Transitional Federal Charter, and whether an amendment of the Transitional Federal Charter by the Transitional Federal Parliament would be needed.
The technical assessment mission therefore recommended the immediate deployment to UNPOS of an adviser in the area of security sector reform to provide strategic advice to the Special Representative of the Secretary-General and senior staff,as well as to the Joint Security Committee and other relevant Somali counterparts.

For the courts being developed in"Somaliland" and"Puntland" to be able to receive suspects captured at sea by naval forces for prosecution, and for"Somaliland" and"Puntland" prisons to be able to receive those convicted in third States for imprisonment,will require agreements between the relevant Somali authorities and third States.
The United Nations Humanitarian Coordinator for Somalia will engage in a series of humanitarian diplomacy initiatives with relevant Somali stakeholders, including clan elders, the business community, religious and political leaders and women's groups, to help secure more humanitarian space in the country.
The Transitional Federal Government and the relevant Somali authorities would need to consider whether the establishment of such a court or section and its location in a third State would raise issues of compatibility with the provisions of the 1960 Constitution and the Transitional Federal Charter, and whether an amendment of the Transitional Federal Charter by the Transitional Federal Parliament would be needed.
Tasks that can be undertaken with limited access to Somalia include increased monitoring, for example, through engagement with refugees, substantive preparation of a conference on transitional justice, and capacity-building initiatives,including workshops on the harmonization of the relevant Somali law with international human rights and humanitarian law.
A constitutional and legislative basis for such participation in national courts would be needed,and the Government and the relevant Somali authorities would need to determine whether there is an issue of compatibility with the provisions of the 1960 Constitution and the Transitional Federal Charter, and, if necessary, to consider amendment of the Transitional Federal Charter by the Transitional Federal Parliament.
