In June, OPORA observers found out about several cases of obstruction to activities of candidates and political parties that were manifested in damaging facilities of local offices of political parties andthe outdoor advertising posted by electoral subjects.
According to OPORA's data, incidents involvingdirect or indirect bribery of voters, for the most part, were organized in favor of aforesaid electoral subjects(more than half of verified incidents).
Therefore, it is no wonder that from the moment of launching the electoral process, much ore intense activity was exercised by potential election participants(parties and candidates),but not the officially registered electoral subjects.
The increasing intensity of election campaign was further propelled by the decision of Constitutional Court of Ukraine on the constitutionality ofpresidential decree on dissolution of Parliament since many potential electoral subjects restrained their campaigning activities in June 2019 in wait for Constitutional Court ruling.
Taking into consideration that there were some incidents that included damage to the premises of the election headquarters and outdoor advertising of some candidates and parties, OPORA calls on law enforcement bodies of Ukraine topay special attention to forceful provocations against electoral subjects.
Liashko against one of the members of DEC No.105 in connection with alleged gross violation of the law that bans members of election commissions from conducting political agitation and disseminating knowingly false ordefamatory information about electoral subjects(member of DEC posted a video address of one of the candidates to his personal page on“Facebook”).
In particular, it goes about the“charity” as well as about the problems of distinguishing activities of the current people's deputies andtheir activities as electoral subjects during the election campaign.
Possibility for rejection of candidate's registration or its cancellation in case of having CEC establish circumstancesconfirming that the person's actions claiming the status of electoral subject are intended to deceive voters, or impede their free will expression(initiative as to preventing“technical candidates”).
As for the goods, electoral process subjects mainly disseminated foodstaff packages among voters, though some candidates before or after their registration by CEC distribuded more unusual presens.
District election commissions, according to practical experience, break this rule and refuse to register a complaint,violating electoral process subjects' rights to appeal decisions, actions or omission.
Special attention will be paid by the Working group to complaints and appeals from citizens and other subjects of the electoral process.
