( 11) Where an international application is filed, on the basis of a Community trade mark application, in a language other than one of the languages allowed under the Madrid Protocol for the filing of international applications, the Office should make its best efforts to arrange for the translation of the list of goods or services into the language indicated by the applicant in order for the application to be forwarded to the International Bureau in time to maintain the date of priority.
Such withdrawal shall take effect three months after the day on which the Director General has received the notification and, in the case of the withdrawal of a declaration made under paragraph(3),shall not affect international applications filed prior the expiration of the said three-month period.
(8) Nothing in this Treaty and the Regulations is intended to be construed as limiting the freedom of any Contracting State to apply measures deemed necessary for the preservation of its national security or to limit, for the protection of the general economic interests of that State, the right of its own residents ornationals to file international applications.
In the case of the said notification, the declaration shall take effect six months after the day on which the Director General has received the notification, andshall not affect international applications filed prior to the expiration of the said six-month period.
(b) The provisions of subparagraph(a) shall also apply in respect of any mark that is the subject of an international registration having effect in Contracting Parties other than the denouncing State or intergovernmental organization at the date on which denunciation becomes effective and whose holder, because of the denunciation,is no longer entitled to file international applications under Article 2(1).
If the national application is in a language which the International Searching Authority considers it is not equipped to handle,the international‑ type search shall be carried out on a translation prepared by the applicant in a language prescribed for international applications and which the International Searching Authority has undertaken to accept for international applications.
(b) The provisions of subparagraph(a) shall also apply in respect of any mark that is the subject of an international registration having effect in Contracting Parties other than the denouncing State or intergovernmental organization at the date on which denunciation becomes effective and whose holder, because of the denunciation,is no longer entitled to file international applications under Article 2(1).
WIPO will then register the international application and send it to EUPIO.
