First, the Commission indicated that the Netherlands authorities had to amend the public service mission entrusted to wocos, in such a way that social housing would be earmarked for a clearly defined target group of underprivileged individuals or socially disadvantaged groups.
After the grant of the abovementioned special reference quantities, the Netherlands authorities carried out checks in order to ascertain whether the applicants were producing the reference quantities under the terms laid down in the Community rules.
Nevertheless, I wish to highlight the fact that the statements made by the Netherlands authorities unequivocally show that they viewed the applicants' situation as one continuous unit of time, with the result that new employment is not a sufficient reason to interrupt permanently the payment of unemployment benefit, which is the realisation of the entitlements acquired by virtue of the period worked before the entry into force of Regulation No 883/2004.
As the Commission correctly asserted in its decision of 3 May 2005 not to raise objections to the risk equalisation scheme andretention of reserves set up by the Netherlands authorities in the health insurance sector, the compensation must be limited to the extraordinary costs of an efficient operator, taking the premiums into account Commission decision of 3 May 2005 relating to State aid N 541/04 and N 542/04- Netherlands- Risk equalisation scheme and retention of reserves, OJ 2005 C 324, p.
As a preliminary matter, the Commission pointed out therein that the Netherlands authorities should redefine the public service mission entrusted to Wocos, so that social housing is reserved for a clearly defined target group of disadvantaged persons or socially disadvantaged groups.
