That declaration shall state the Union acts concerned and their publication references.
The Union acts to which this Regulation applies and the corresponding regulatory information requirements are listed in part A of Annex I.

Upon request of one or more Member States and in fulfilling its tasks,the Authority shall provide information to support the Member State concerned in the effective application of the Union acts that fall within the Authority's competence.

(a) the adequacy of resources,the degree of independence, and governance arrangements of the competent authority, with particular regard to the effective application of the Union acts referred to in Article 1(2) and the capacity to respond to market developments;

In cases specified in the Union acts referred to in Article 1(2) as well as in cases of significant disagreement between two or more national competent authorities concerning the application of those acts and without prejudice to the powers laid down in Article 17, the Authority may assist the competent authorities in reaching an agreement in accordance with the procedure set out in paragraphs 2 to 4 in either of the following circumstances.
(1)‘breaches' means actual or potential unlawful activities, omissions orabuse of law relating to the Union acts and, notably in areas falling within the scope referred to in Article 1 and in the Annex;
Pursuant to the principle of subsidiarity the Union acts in the framework of its competences only when its action is essential and brings added value to the actions of Member States.
Any natural or legal person, including competent authorities, may appeal against a decision of the Authority referred to in Articles 16, 16a, 17, 18, 19, and 35 including regarding its proportionality andany other decision taken by the Authority in accordance with the Union acts referred to in Article 1(2) which is addressed to that person, or against a decision which, although in the form of a decision addressed to another person, is of direct and individual concern to that person.
Please be advised that the representative in the Union acts on behalf of the controller or processor it represents with regards to the controller or processor's obligations under the GDPR.
If the Union act in the Annex has been or will be amended, the reference relates to the act as amended;
If the Union act in the Annex has been or will be replaced, the reference relates to the new act. .
It must be emphasised that under indent(b)of the first paragraph of Article 267 TFEU the admissibility of a reference for a preliminary ruling made on the basis of that provision is not subject to a condition that such a party has complied with a time‑limit within which a case challenging the validity of the Union act concerned must be brought before the national court or tribunal with jurisdiction.
