( 2) Ако Концедент у року од 21 дан не поступи по упутама Комисије, сматрат ће се да је приједлог јавног позива повучен.
(2) If the Conceding Party does not act upon the instructions of the Commission within 21 days, it shall be deemed that the proposal of the public invitation has been withdrawn.

The assessment of the existence of public interest is made by the conceding party, especially in cases of unsolicited proposal to be granted a concession.

( 1) Концедент је обавезан да упути на објаву јавни позив у року од 15 дана од дана пријема одлуке о прихватању приједлога јавног позива.
(1) The Conceding Party shall be bound to have the public invitation announced within 15 days from the day of the receipt of the decision to accept the proposal of the public invitation.

( 1) Надлежни министар закључује уговор, а Концедент обавјештава Парламентарну скупштину Босне и Херцеговине о коначној одлуци о додјели концесије.
(1) The competent minister shall conclude the contract and the Conceding Party shall notify the Parliamentary Assembly of Bosnia and Herzegovina on the final decision pertaining to the concession granting.

( 1) Концедент у року од 30 дана од дана отварања понуде обавјештава Комисију о ранг-листи и најуспјешнијем понуђачу.
(1) Within 30 days from the day of opening the bids, the Conceding Party shall notify the Commission on the rating list and the most successful bidder.

( 1) По пријему одлуке о прихватању студије економске оправданости, Концедент доставља Комисији на разматрање и одобравање приједлог јавног позива са пратећом документацијом.
(1) Upon the receipt of the decision to accept the feasibility study, the Conceding Party shall submit to the Commission a proposal of public invitation with the accompanying documents, for consideration and approval.

( 1) Ако приспјеле понуде не задовољавају тражене увјете из јавног позива, Концедент уз сагласност Комисије за концесије понавља поступак објављивања јавног позива.
(1) If the bids submitted do not met the required conditions specified in the public invitation, the Conceding Party shall, with the consent of the Commission on Concessions, repeat the procedure of announcing a public invitation.

( 1) Концедент формира експертну тендерску комисију од најмање пет чланова, од којих најмање три члана морају бити стручњаци за област из које се додјељује концесија.
(1) The Conceding Party shall establish an expert tender commission of at least five members, of which at least three members must be experts in the field in which the concession is being granted.

( 1) Копије закљученог уговора са пратећом документацијом Концедент доставља Комисији која врши увид у закључени уговор о концесији и архивира га заједно са пратећом документацијом.
(1) The Conceding Party shall submit copies of the contract concluded, with the accompanying documents, to the Commission, which shall review the concession contract concluded and archive it together with the accompanying documents.

Концесионар је правно лице основано у складу са законима Босне и Херцеговине, с којим концедент закључује уговор о концесији, и има права и обавезе утврђене уговором и овим законом.
The Concessionaire is a legal entity established pursuant to the laws of Bosnia and Herzegovina with whom the Conceding Party shall conclude a Concession Contract, and having the rights and obligations under this Contract and this Law.

( 1) Ако приједлог јавног позива не садржи прописане увјете, Комисија уз препоруку враћа приједлог јавног позива Концеденту на измјене и допуне.
(1) If the proposal of the public invitation does not fulfill the prescribed conditions, the Commission shall return the proposal of the public invitation to the Conceding Party with a recommendation to make amendments.

Концесија”- право које Концедент додјељује у сврху обезбјеђивања изградње инфраструктуре и/ или услуга експлоатације природних ресурса, у роковима и под условима у којима се Концедент и Концесионар договоре.
Concession"- the right granted by a Conceding Party to provide the construction of infrastructure and/or services and to exploit natural resources under terms and conditions agreed on by Conceding Party and Concessionaire.

( 2) Оглас о међународном јавном позиву објављује се и на енглеском језику у новинама са међународним оптицајем и на wеб страници Концедента или Савјета министара.
(2) The announcement of an international public invitation shall be published also in English in a paper with international circulation as well as on the web page of the Conceding Party or the Council of Ministers.

Изузетно, ако концесионар из става 1. ограничава конкуренцију и ствара монопол на тржишту у било ком сектору у Босни и Херцеговини, Комисија има право ревизије уговора између концесионара и концедента, као и ревизију уговора из члана 30. став 3.
Exceptionally, in event that the Concessionaire under paragraph 1 limits competition and creates monopoly at the market in any sectors in Bosnia and Herzegovina, the Commission shall be entitled to review the contract concluded between the Concessionaire and the Conceding party, as well as the contract referred to in Article 30, paragraph 3.
