It is appropriate, therefore,to lay down stricter rules concerning the management of such stockpiles compared to those laid down in the Convention.
Consequently, the Parliament will amend the law so as some restrictions remain for certain categories of information, butthe legal norm should not be more restrictive than the rules laid down in the Convention.
With a view to harmonising to the benefit both of passengers and of carriers,deletion of a clause from the Convention whereby a Member State may individually adopt compensation ceilings higher than those laid down in the Convention.

This Convention is offering the citizens of the Member States of the EuropeanCouncil the right to address the European Court of Human Rights(ECHR) with individual complaints when the countries violate the rights laid down in the Convention.

(33) Whereas, in view of the need to protect the integrity of the human person during the sampling, collection and use of substances derived from the human body,it is appropriate to apply the principles laid down in the Convention of the Council of Europe for the protection of human rights and dignity of the human being with regard to the application of biology and medicine; whereas, furthermore, national regulations relating to ethics continue to apply;

Nevertheless, it seems appropriate that articles containing chemicals that could be released under conditions of use or disposal and that are banned or severely restricted in the Community within one ormore of the use categories laid down in the Convention or are subject to the international PIC procedure should also be subject to the export notification rules.
(22) However, and in spite of the fact that the protection of the aforementioned Convention is not fully applicable to beneficiaries of subsidiary protection,the Geneva Convention must be regarded as an instrument which is a compulsory reference point for interpreting those provisions of the directive which contain the same rights as those laid down in the Convention.
Whereas on the basis of the Agreement on Good Neighbourly Relations between France and Monaco of 18 May 1963, as revised and supplemented by an exchange of letters between France and Monaco of 15 December 1997,the French authorities apply the rules and checks laid down in the Convention implementing the Schengen Agreement when carrying out checks on the entry, stay and establishment of foreign nationals in the Principality of Monaco.
Nevertheless, it seems appropriate that articles containing chemicals that could be released under certain conditions of use or disposal and that are banned or severely restricted in the Union Community within one ormore of the use categories laid down in the Convention or are subject to the international PIC procedure should also be subject to the export notification rules.
(3) Council Directive 98/58/EC of 20 July 1998 concerning the protection of animals kept for farming purposes(5), drawn up on the basis of the European Convention for the Protection of Animals kept for Farming Purposes,lays down Community provisions designed to give effect to the principles laid down in the Convention, which include the provision of housing, food, water and care appropriate to the physiological and ethological needs of the animals;
This is laid down in the European Convention on Human Rights.
(10) Member States may establish standards higher than the minimum standards laid down in the STCW Convention and this Directive.
We will also ensure that the text complies with the standards laid down in the European Convention on Human Rights and in the case-law of the European Court of Human Rights, as well as in the Charter of Fundamental Rights.
