In the reporting period, there has been increased communication between the Association of Defence Counsel and the Tribunal.
An Association of Defence Counsel has been created as the equivalent of a Bar.
The Working Group also met with representatives of the Office of the Prosecutor and the Association of Defence Counsel.
Two members of the Association of Defence Counsel also serve as non-voting members.
The non-voting members include the Prosecutor,the Registrar and a representative of the Association of Defence Counsel.
This year, we have also improved communication between the Association of Defence Counsel and the Tribunal in an effort to boost efficiency in proceedings.
The Association of Defence Counsel also has a disciplinary committee and may police itself for ethical problems in accordance with the Code of Conduct.
The working group on speeding up trials is still awaiting consultations with the Association of Defence Counsel before its report can be completed.
Many defence counsel are organized into the Association of Defence Counsel practising before the Tribunal, a key body in maintaining a dialogue between the Tribunal and counsel on financial and other procedural issues.
The Tribunal provided the draft policy that is currently undergoing the approval process,including recommendation by the Association of Defence Counsel.
Talks are also underway between the Registry,Prosecution and Association of Defence Counsel to devise ways to ensure these trials run as smoothly as possible.
During the reporting year, the Office for Legal Aid andDetention Matters and the Association of Defence Counsel worked closely and intensively on a number of defence matters.
The non-voting members of the Rules Committee are two representatives each from the Office of the Prosecutor,the Registry and the Association of Defence Counsel.
The Board noted that the Office of Legal Aid and Detention,in coordination with the Association of Defence Counsels, had adopted a remuneration package for defence counsels on the trial of cases.

Once recommendations or suggestions have been agreed upon, the Office of the Prosecutor and the Association of Defence Counsel will be consulted with a view to coming to a common understanding on how such measures will be incorporated into pre-trial and trial proceedings.
While the lump-sum payment scheme would effectively contain these costs, it cannot be applied retroactively to ongoing cases, andthe Rwanda Tribunal has engaged in discussions with the Association of Defence Counsel regarding the adoption of the new system.
The Association of Defence Counsel has shown a willingness to cooperate with the Tribunal in following the completion strategy through its dedication to using the e-Court system and its negotiations with the Prosecution over issues related to disclosure of materials.
It is envisaged that the hourly payment policy will be replaced by a lump sum legal aid policy as soon as consultations with the Association of Defence Counsel are completed; this policy is expected to be adopted in the later part of 2009.
The Association of Defence Counsel also made a statement to the judges at the plenary praising the progress it had made with the Registry in implementing reforms and urging judicial support for much needed reforms on which progress still needed to be made.
In view of the increased numberof appellate proceedings anticipated for the biennium 2010-2011, the Registry, in consultation with the Association of Defence Counsel, is currently finalizing a lump-sum legal aid policy for appeals.
The Office continued working in close cooperation with the Association of Defence Counsel to ensure the professional integrity of counsel and engaged the Association of Defence Counsel in consultations on major decisions and policies affecting the work of defence counsel. .
Further, in the light of the expected high number of appellate proceedings during the next biennium, the Registry, in consultation with the Association of Defence Counsel, is finalizing a lump-sum legal-aid policy for appeals.
Within the framework of the project and in cooperation with the Association of Defence Counsel Practising before the International Tribunal for the Former Yugoslavia(ADC-ICTY), the Institute has prepared the Manual on International Criminal Defence: ADC-ICTY Developed Practices.
Following the report drawn up by the Office of Internal Oversight Services(OIOS) and faced with the need to ensure better management of legal aid, the Office of Legal Aid andDetention Matters encouraged the creation of an Association of Defence Counsel appearing before the Tribunal.
In support of Mr. Ojdanić's appeal, the Association of Defence Counsel of ICTY requested leave to file an amicus curiae brief on 29 August 2003. On 13 November 2003, the Appeals Chamber by majority(Judges Weinberg de Roca(presiding), Pocar, Shahabuddeen, Hunt and Güney), dismissed the appeal, Judge Hunt dissenting.
One example is the publication of a manual on international criminal defence in the framework of the War Crimes Justice Project, undertaken jointly by the International Tribunal for the Former Yugoslavia, the Organization for Security and Cooperation in Europe and the United Nations Interregional Crime and Justice Research Institute,in cooperation with the Association of Defence Counsel Practising before the International Tribunal for the Former Yugoslavia.
Two working groups of judges have been appointed by the President and through a process of consultation with the Office of the Prosecutor,the Registry and the Association of Defence Counsel, the working groups have formulated a number of strategies aimed at increasing the efficiency of trials and appeals without impinging upon fundamental principles of fair trial and due process.
