The Commission decided that it shouldbe represented at the sixty-seventh session of the General Assembly by its Chairman, Mr. Lucius Caflisch.

Beckett, Charles de Visscher, Jones, Paul de Visscher, Petrén,Kiss and Caflisch favoured such a rule, while de Aréchaga and O'Connell opposed it.
Mr. Caflisch said that he had only a few comments to make on the draft conclusions, which, in his opinion, should all be sent to the Drafting Committee.
The Commission, at its 3012th meeting on 29 May 2009, decided to appoint Mr. Lucius Caflisch as Special Rapporteur for the topic"Effects of armed conflicts on treaties.
It also acknowledged the untiring efforts andcontribution of the Working Group on Effects of armed conflicts on treaties under the chairmanship of Mr. Lucious Caflisch.
The Commission appointed Mr. Lucius Caflisch as Special Rapporteur of the topic"Effects of armed conflicts on treaties" chap. XII, sect. A.1.
Following the resignation from the Commission of Mr. Ian Brownlie,Special Rapporteur for the topic"Effects of armed conflicts on treaties", Mr. Lucius Caflisch had been appointed to replace him.
At its sixty-first session(2009), the Commission appointed Mr. Lucius Caflisch as Special Rapporteur for the topic, following the resignation of Sir Ian Brownlie from the Commission.
Mr. Caflisch(Observer for Switzerland) said that the draft articles prepared by the Commission on nationality in relation to the succession of States were well thought out, and that he endorsed the five main principles underlying them.
As regards the topic"Effects of armed conflicts on treaties", the Commission considered the third report of the Special Rapporteur(A/CN.4/578 and Corr.1) anddecided to establish a Working Group under the Chairmanship of Mr. Lucius Caflisch.
Mr. Lucius Caflisch, Chairman of the International Law Commission, Mr. Markus Schmidt, Director of the Seminar, and Ms. Mariam Al-Hail(Qatar), on behalf of the participants of the seminar, addressed the Commission and the participants during the closing ceremony of the Seminar.
It is therefore obvious that as regards the nationality of legal persons, State succession can give rise to conflicts that are negative(statelessness) or positive(dual nationality or multiple nationality), andthese problems are not merely academic. Cf. Caflisch, op. cit., pp. 150-151.

Mr. Caflisch, referring to the understanding reached at the previous session that the work on the topic should not interfere with relevant political negotiations, said that it was not clear how the Commission could know in advance the content of any future negotiations on the broad range of issues that were relevant to the topic.
In conclusion to his overview of the draft articles, he drew attention to paragraphs 98 and 99 of the Commission's report,which recorded its tribute to the Special Rapporteur, Mr. Lucius Caflisch, under whose able guidance the work had been brought to a successful conclusion, and to the previous Special Rapporteur, Sir Ian Brownlie.
Mr. Caflisch(Observer for Switzerland) said that, as a result of the conflicts in the former Yugoslavia and Rwanda, the international community had fully realized the consequences of the impunity of individuals for acts of genocide, crimes against humanity and war crimes, consequences which also affected the prevention of such crimes.
As in the case of an individual, the existence of the bond of nationality is necessary for the purposes of application of international law in relation to a legal person, and, most often,for the purposes of diplomatic protection. Mr. Caflisch(Special Rapporteur on the effects of armed conflicts on treaties), commenting on the discussions of the draft articles on the effects of armed conflicts on treaties, said it was regrettable that questions had been raised concerning the utility of the draft articles and the insufficiency of practice on which they were based.
