Consultancy and security services on.
There is an urgent need to regulate private military assistance, consultancy and security companies and establish criminal liability for members of such companies.
Xi. proposals on possible means of regulation and international supervision of the activities of private companies offering military assistance, consultancy and security services.
This must include any kind of recruitment, training, hiring orfinancing of mercenaries by private companies offering international military consultancy and security services, as well as a specific ban on such companies' intervening in armed conflicts or actions to destabilize constitutional regimes.
Pursuant to its mandate, the Working Group has continued to monitor mercenaries and mercenary-related activities in all their forms and manifestations,as well as to study the effects on the enjoyment of human rights of the activities of private companies offering military assistance, consultancy and security services on the international market.
Requests all States to exercise the utmost vigilance against any kind of recruitment, training,hiring or financing of mercenaries by private companies offering international military consultancy and security services, as well as to impose a specific ban on such companies' intervening in armed conflicts or actions to destabilize constitutional regimes;
Encourages Governments which import the military assistance, consultancy and security services provided by private companies to establish regulatory mechanisms for the registeringand licensing of these companies in order to ensure that imported services provided by these private companies neither impede the enjoyment of human rights nor violate human rights in the recipient country;

Encourages States that import the military assistance, consultancy and security services provided by private companies to establish regulatory national mechanisms for the registeringand licensing of those companies in order to ensure that imported services provided by those private companies neither impede the enjoyment of human rights nor violate human rights in the recipient country;
It recommended the development of national legislation to address mercenaries, mercenary-related activities and the activities of private companies offering military assistance, consultancy and security services on the international market.
Recommends that States outsourcing activities relating to military assistance, consultancy and security services to private military and security companies should demand the authorization of States from which former military personnel and policemen are recruited by such companies to work in armed conflict or post-conflict situations before the recruitment takes place;

In its resolution 2005/2, the Commission on Human Rights requested the Working Group to monitor and study the effects of the activities of private companies offering military assistance, consultancy and security services on the international market on the enjoyment of human rights, particularly the right of peoples to self-determination, and to prepare draft international basic principles that encourage respect for human rights on the part of those companies in their activities.
The Working Group and participants discussed general guidelines, norms and basic principles for the regulation and oversight of the activities of private companies offering military assistance, consultancy and security services on the international market.
Recommends that, in order toensure that the military assistance, consultancy and security services offered by private companies at the international level neither impede the enjoyment of nor violate human rights, Governments of States from which these private companies export such services adopt legislation and set up regulatory mechanisms to control and monitor their activities, including a system of registering and licensing that would authorize these companies to operate and allow them to be sanctioned when the norms are not respected;
The Working Group on the use of mercenaries was concerned about aspects of the activities of Fijians recruited to work for private companies offering military assistance, consultancy and security services in situations of violenceand armed conflict such as in Iraq.

The Chairperson-Rapporteur and one Working Group member visited Honduras from 21 to 25 August 2006, at the invitation of the Government, to study the situation and verify information received concerning the recruitment and training of individuals from Honduras and other Latin American countries to perform security services in countries of conflict, and the legislation and regulation of private security companies offering military assistance,training, consultancy and security services operating in Honduras.

It is mandated, inter alia, to monitor mercenaries and mercenary-related activities in all their forms and manifestations in different parts of the world, and to study the effects on the enjoyment of human rights of the activities of private companies offering military assistance, consultancy and security services on the international market.
