During its twenty-eighth session, on 13 May 2002 the Committee held its day of general discussion on the equal right of men and women to the enjoyment of all economic, social andcultural rights set forth in the Covenant art. 3.

The Committee is concerned that the Covenant has not been translated into the official languages of Bosnia and Herzegovina and that judges, prosecutors andlawyers are not fully aware of the direct applicability of the provisions of the Covenant art. 2.

With the ratification of Covenant I, Switzerland has committed itself to implement all provisions without discrimination, andto guarantee that every person living in Switzerland has an equal opportunity to enjoy the rights contained in the Covenant art. 2.

The Committee is also concerned that the State party has still not withdrawn all reservations to the Covenant art. 2.

Taken together, these elements considerably limit the legal reach andpractical relevance of the Covenant art. 2.
IV. Equality in regard to enjoyment of the rights set forth in the Covenant art. 3.
It further regrets the absence of court cases invoking the provisions of the Covenant art. 2.
It also notes that the State party has not yet acceded to any of the two Optional Protocols to the Covenant art. 2.

It is also concerned that the lack of registration results in difficulties in the access to andenjoyment of their rights under the Covenant art. 10.
The Committee also regrets the limited information on domestic court decisions which make reference to provisions of the Covenant art. 2.
Furthermore, the Committee regrets that judicial decisionsmake little reference to international human rights law, including the Covenant art. 2.
The Committee considers that this situation deprives Haitian citizens of their right to vote andbe elected at periodic elections in accordance with the Covenant art. 25.
The Committee is concerned by the fact that the State party maintains the declarations that it made upon ratifying both optional protocols to the Covenant art. 2.
The Committee is also concerned that judges have used sharia law and fatwas to reach a verdict that was in contravention of the rights andprinciples as laid down in the Covenant art. 14.
It is also concerned at the lack of information on mechanisms for ensuring the compatibility of the native indigenous campesino justice system with the Covenant art. 14.
The Committee notes with concern the lack of clarity in the legal provisions allowing the authorities to declare a state of emergency andto derogate from obligations provided for in the Covenant art. 4.
The Committee is further concerned that the maximum available resources are not used by the State party to progressively achieve the full realization of the rights recognized in the Covenant art. 2, para. 1.
The Committee regrets the lack of information on the situation of national and ethnic minorities in the State party andon their actual enjoyment of rights under article 15 of the Covenant art. 15.
The Committee is concerned about the extent of corruption in the State party and its adverse impact on the enjoyment of all human rights, including economic, social andcultural rights protected under the Covenant art. 2, para. 1.
Moreover, the Committee is concerned that the legislative and policy-making processes do not allow for a review of the compatibility of draft laws, regulations andpolicies with the rights enshrined in the Covenant art. 2, para. 1.
To the extent that the author was restricted in his ability to challenge all the evidence against him, this was done for national security reasons, in accordance with Canadian law which the Committee has viewed as satisfactory, andwhich is consistent with the Covenant art. 13.
The Committee takes note of proposals to repeal article 2, paragraph 2, second sentence, of the Constitution, which provides that individuals professing the EvangelicalLutheran religion are bound to bring up their children in the same faith andreiterates its concern that this provision is incompatible with the Covenant art. 18.
The Committee is deeply concerned about the insufficient attention by the State party to its obligation under the Covenant concerning cultural rights, as revealed by the total absence of information within the periodic report,as well as by the lack of answers to the list of issues related to article 15 of the Covenant art. 15.
The Committee is concerned that the definition contained in the State party's Penal Code(sect. 122) is too narrow and is not in conformity with the definition provided in article 1 of the Convention against Torture and Other Cruel, Inhuman or Degrading Treatment and Punishment, norwith article 7 of the Covenant art. 7.
