Further to the information concerning border controls provided in the report of Monaco submitted to the Counter-Terrorism Committee pursuant to paragraph 6 of Security Council resolution 1373(2001), in document S/2002/93, commentary concerning paragraph 2, subparagraph(g), it should be noted that, in implementation of the Convention between France and Monaco of 18 May 1963, the stay of foreign nationals in Monaco is subject to the prior agreement of the French authorities.

The Committee considered the initial report of Monaco(CAT/C/21/Add.1) at its 195th and 196th meetings, held on 10 November 1994(see CAT/C/195 and 196 and Add.2), and adopted the following conclusions and recommendations.

Mr. Diaconu, referring to the concluding observations of the Human Rights Committee on the second periodic report of Monaco(CCPR/C/MCO/CO/2), expressed concern that in the State party bodies corporate could be established by simple declaration, and that it was left to the discretion of the authorities to decide whether such a body was sectarian in nature.

The Committee, considering that the second periodic report of Monaco also covers the third report due on 4 January 2001, requests the State party to submit its fourth and fifth reports in a single document on 4 January 2009.
