Determination of administrative sanctions and other administrative measures.
Competent authorities shall provide EIOPA annually with aggregated information regarding all administrative sanctions and other measures imposed in accordance with Article 31.
Administrative sanctions and other administrative measures shall be effective, proportionate and dissuasive.
The competent authority shall, on an annual basis, provide ESMA with aggregate information regarding all administrative sanctions and other administrative measures imposed in accordance with Article 38.
The administrative sanctions and other administrative measures referred to in the first subparagraph of paragraph 1 shall include the following.
In the event of an infringement referred to in paragraph 1, Member States shall,in conformity with national law, confer on competent authorities the power to impose at least the following administrative sanctions and other administrative measures.
The administrative sanctions and other administrative measures taken for the purpose of paragraph 1 shall be effective, proportionate and dissuasive.
In the event of any of the breaches referred to in point(e) of paragraph 1, Member States shall ensure that the competentauthorities have the power to impose, in accordance with national law, at least the following administrative sanctions and other measures▌.
The rules on administrative sanctions and other measures applicable to breaches of national provisions adopted pursuant to this Directive.
In the event of an infringement referred to in paragraph 1, Member States shall,in conformity with national law, confer on competent authorities the power to impose at least the following administrative sanctions and other administrative measures.
Member States shall ensure that administrative sanctions and other measures taken in accordance with this Article are subject to a right of appeal.
In the event of any of the breaches referred to in point(e) of paragraph 1, Member States shall ensure that the competentauthorities have the power to impose, in accordance with national law, at least the following administrative sanctions and other measures▌.
Therefore, a set of administrative sanctions and other administrative measures should be provided for to ensure a common approach in Member States and to enhance their deterrent effect.
In the event of any of the breaches referred to in points(a) to(d) and(f) of paragraph 1, Member States shall ensure that the competentauthorities have the power to impose, in accordance with national law, at least the following administrative sanctions and other measures.
Therefore, administrative sanctions and other measures laid down by Member States should satisfy certain essential requirements in relation to addressees, criteria to be taken into account when applying a sanction or other measure, and publication.
Without prejudice to the supervisory powers of competent authorities, at least in the event of an infringement referred to in this Article,the competent authorities shall, in conformity with national law, have the power to impose at least the following administrative sanctions and other measures.
In the exercise of their powers to impose administrative sanctions and other administrative measures under Article 42, competent authorities shall cooperate closely to ensure that the supervisory and investigative powers and administrative sanctions and other administrative measures produce the desired results of this Regulation.
If such publication causes disproportionate damage to the persons involved or jeopardises the stability of financial markets oran ongoing investigation the competent authority should publish the administrative sanctions and other administrative measures on an anonymous basis in accordance with national law or delay the publication.
Therefore, administrative sanctions and other administrative measures laid down by Member States should satisfy certain essential requirements in relation to addressees, criteria to be taken into account when applying a sanction or other administrative measure, publication of sanctions or other administrative measures, key penalising powers and levels of administrative fines.
Without prejudice to any criminal sanctions and without prejudice to the supervisory powers of competent authorities under Article 23,Member States shall, in accordance with national law, provide for competent authorities to have the power to take appropriate administrative sanctions and other administrative measures in relation to at least the following infringements.
In the exercise of their sanctioning powers in the circumstances defined in Article 63 competent authorities shall cooperate closely to ensure that the administrative sanctions and other measures produce the results pursued by this Regulationand coordinate their actions in order to avoid any duplication or overlap when applying administrative sanctions and other measures to cross border cases in accordance with Article 14.
Without prejudice to the supervisory powers of competent authorities in accordance with Article 41, and the right of Member States to provide for and impose criminal sanctions, Member States shall, in conformity with national law, provide for competent authorities to have the power to impose appropriate administrative sanctions and other administrative measures in relation to at least the following infringements.
Without prejudice to the right of Member States to provide for and impose criminal sanctions, Member States shall lay down rules on and ensure that their competent authorities may impose the administrative sanctions and other measures applicable in the circumstances defined in Article 63 to the persons responsible for infringements of the provisions of this Regulationand shall take all measures necessary to ensure that they are implemented.
Therefore, in order to ensure effective compliance by CSDs, credit institutions designated as settlement agents, the members of their management bodies and any other persons who effectively control their business or any other persons with the requirements of this Regulation,competent authorities should be able to apply administrative sanctions and other measures which are effective, proportionate and dissuasive.
The competent authorities shall be able to apply administrative sanctions and other measures, to CSDs, designated credit institutions, and, subject to the conditions laid down in national law in areas not harmonised by this Regulation, the members of their management bodies and any other persons who effectively control their business as well as to any other legal or natural person who under national law is held responsible for an infringement.
Points out that the only penalty for a controller acting in breach of the Privacy Shield Principles is deletion from the Privacy Shield list;fails to see this as essentially equivalent to the administrative sanctions and other penalties provided in EU data protection law, especially the General Data Protection Regulation;
(58) In order to ensure compliance with the provisions of this Regulation by financial undertakings that manufacture PEPP, as well as by financial undertakings and persons that distribute PEPP, and to ensure that they are subject to similar treatment across the Union, administrative sanctions and other measures which are effective, proportionate and dissuasive should be provided.
Without prejudice to the supervisory powers of competent authorities referred to in Article 98 and the right of Member States to provide for and impose criminal sanctions, Member States shall lay down rules on administrative sanctions and other administrative measures to be imposed on companies and persons in respect of infringements of national provisions transposing this Directive and shall take all measures necessary to ensure that they are implemented.
For the correct application of this Regulation, it is necessary that Member States take all necessary measures in order toensure that their national law comply by 3 July 2016 with the provisions of this Regulation concerning competent authorities and their powers, administrative sanctions and other administrative measures, the reporting of infringements and the publication of decisions.
Without prejudice to the supervisory powers of competent authorities and the right of Member States to provide for and impose criminal sanctions, Member States shall ensure that their competent authorities may impose administrative sanctions and other measures applicable to all infringements of the national provisions implementing this Directive,and shall take all measures necessary to ensure that they are implemented.
