The Assembly of States Parties.

An Assembly of States Parties to this Statute is hereby established.
A decision as to the removal from office of a judge, the Prosecutor or a Deputy Prosecutor under paragraph 1 shall be made by the Assembly of States Parties, by secret ballot.
In February 2003, the Assembly of States Parties began their first session to elect the eighteen judges of the Court.
Amendments under this article on which consensus cannot be reached shall be adopted by the Assembly of States Parties or by a Review Conference, by a two- thirds majority of States Parties.

The ICC is functionally independent of the UN in terms of personnel and financing, butsome meetings of the ICC governing body, the Assembly of States Parties to the Rome Statute, are held at the UN.

Any other dispute between two or more States Parties relatingto the interpretation or application of this Statute which is not settled through negotiations within three months of their commencement shall be referred to the Assembly of States Parties.
Except as otherwise specifically provided, all financial matters related to the Court and the meetings of the Assembly of States Parties, including its Bureau and subsidiary bodies, shall be governed by this Statute and the Financial Regulations and Rules adopted by the Assembly of States Parties.
After the adoption of the Rules of Procedure and Evidence, in urgent cases where the Rules do not provide for a specific situation before the Court, the judges may, by a two-thirds majority, draw up provisional Rules to be applied until adopted, amended orrejected at the next ordinary or special session of the Assembly of States Parties.
The text of any proposed amendment shall be submitted to the Secretary-General of the United Nations orsuch other person designated by the Assembly of States Parties who shall promptly circulate it to all States Parties and to others participating in the Assembly. .
(c)(i) Once a proposal for an increase in the number of judges has been adopted under subparagraph(b),the election of the additional judges shall take place at the next session of the Assembly of States Parties in accordance with paragraphs 3 to 8 inclusive, and article 37, paragraph 2;
Where a State Party fails to comply with a request to cooperate by the Court contrary to the provisions of this Statute, thereby preventing the Court from exercising its functions and powers under this Statute, the Court may make a finding to that effect andrefer the matter to the Assembly of States Parties or, where the Security Council referred the matter to the Court, to the Security Council.
