The 1998 Convention on access to information,public participation in decision-making and access to justice in environmental matters(12)(‘the Aarhaus Convention') also touches on environmental assessment.

On 25 June 1998 the European Community signed the UN/ECE Convention on Access to Information,Public Participation in Decision-Making and Access to Justice in Environmental Matters(‘the Aarhus Convention').
The Convention guarantees the rights of access to information,public participation in decision-making and access to justice in environmental matters in order to contribute to the protection of the right of every person of“present and future generations” to live in an environment adequate to his or her health and well-being.
Representatives of the NGOs and environmental lawyers met to discuss ways of overcoming the legislative and institutional pressure on the public participation in decision-making and access to justice.

What is their response to the United Nations Economic Commission for Europe Convention on access to information,public participation in decision-making and access to justice in environmental matters(the Aarhus Convention).
The EU has signed the UN/ECE Convention on Access to Information,Public Participation in Decision-Making and Access to Justice in Environmental Matters(the Aarhus Convention) on 25 June 1998 and ratified it on 17 February 2005.
Having regard to Council Decision 2005/370/EC of 17 February 2005 on the conclusion, on behalf of the European Community, of the Convention on access to information,public participation in decision-making and access to justice in environmental matters(Aarhus Convention).
That directive not only contains rules relating to information,public participation in decision-making and access to justice, but also, more generally, rules harmonising the assessment of the effects of certain public and private projects on the environment.
The legal definition of“public concerned” was transposed into the national Bulgarian legislation from the Aarhus Convention on Access to Environmental Information,Public Participation in Decision-Making and Access to Justice in Environmental Matters(The Aarhus Convention for short).
It is appropriate to deal with the three pillars of the Aarhus Convention, namely access to information,public participation in decision-making and access to justice in environmental matters, in one piece of legislation and to lay down common provisions regarding objectives and definitions.
The Commission shall make the information in paragraph 3 publicly available in accordance with Regulation(EC) No 1367/2006 of the European Parliament and of the Council of 6 September 2006 on theapplication of the provisions of the Aarhus Convention on Access to Information, Public Participation in Decision-making and Access to Justice in Environmental Matters to Community institutions and bodies(10).
The implementation of this Directive should, where relevant, reflect the Convention on Access to Information,Public Participation in Decision-Making and Access to Justice in Environmental Matters, in particular as implemented through Directive 2003/4/EC of the European Parliament and of the Council(17).
Article 1 of the Aarhus Convention, which is entitled‘Objective', provides that‘[i]n order to contribute to the protection of the right of every person of present and future generations to live in an environment adequate to his or her health and well-being, each Party shall guarantee the rights of access to information,public participation in decision-making, and access to justice in environmental matters in accordance with the provisions of this Convention'.
(a) Review the policies for and legal and methodological approaches to access to information,public participation in decision-making and access to justice in environmental matters, with a view to further improving them;

This Regulation implements the Aarhus Convention on Access to Information,Public Participation in Decision-making and Access to Justice in Environmental Matters to Community Institutions and Bodies.
It is necessary to amend Directive 2003/35/EC of the European Parliament and of the Council(8) with a view to ensuring consistency of that Directive with the UNECE Conventionon Access to Information, Public Participation in Decision-Making and Access to Justice in Environmental Matters of 1998(the‘Aarhus Convention').
The right of access to environmental information is established in the Convention on access to information,public participation in decision-making and access to justice in environmental matters(5)(‘the Aarhus Convention'), which was signed by the Community on 25 June 1998 in Aarhus(Denmark).
In order to contribute to the protection of the right of every person of present and future generations to live in an environment adequate to his or her health and well-being, each Party shall guarantee the rights of access to information,public participation in decision-making, and access to justice in environmental matters in accordance with the provisions of this Convention.
The United Nations' Economic Commission for Europe Convention onAccess to Environmental Information, Public Participation in decision-making and Access to Justice in Environmental Matters is signed in Aarhus, Denmark.
Objective of the Convention is to contribute to the protection of the right of every person of present and future generations to live in an environment adequate to his or her health and well-being, each Contracting Party to this convention shall guarantee the rights of access to information,public participation in decision-making, and access to justice in environmental matters in accordance with the provisions of this Convention.
This regulation refers to the application of the provisions of the Aarhus Convention on Access to Information,Public Participation in Decision-making and Access to Justice in Environmental Matters to Community institutions and bodies.
The legal rights which each Party undertakes to guarantee under article 1 are limited to the rights of access to information,public participation in decision-making and access to justice in environmental matters in accordance with the provisions of this Convention.".
The Union should ensure access to information and public participation, implementing the UN/ECE Convention on access to information,public participation in decision-making and access to justice in environmental matters(Aarhus Convention), which was approved by the Union on 17 February 20051a.
