From 5 to 7 February 2019 A meeting of the Parties to the Convention on Environmental Impact Assessment in a Transboundary Context(the Espoo Convention) was held.
The Espoo Convention on Environmental Impact Assessment in a Transboundary Context(7) was signed in 1991 and approved on behalf of the then European Community in 1997.
In such cases the authorities of the relevant countries shall be notified in accordance with the Espoo Convention and the Act on Environmental Assessment of Plans and Programmes.
However, the provisions of the Espoo Convention are not very clearly structured in this respect and the national EIA systems, not being identical, cannot remove all remaining uncertainties.
The Meeting of the Parties to the Convention on Environmental Impact Assessment in a Transboundary Context(Espoo Convention) will be held in Geneva on 5-7 Feb. 2019.
We must therefore insist that Russia ratifies the Espoo Convention on Environmental Impact Assessment in a Transboundary Context that it signed in 1991, and the Finnish Government should make this a condition of processing the gas pipeline's construction permit.
In the field of biodiversity protection there are some EIA standards and procedures, established under relevant international andEC legal instruments that are more stringent than those of the Espoo Convention.
All of the states around the Baltic Sea have worked together now for more than three years within the framework of the Espoo Convention to determine how these obligations relate to how this project is to be executed.
I find it incomprehensible how some have been prepared to agree to a gas pipeline running through the Baltic Sea without any obligation on the part of Russia even to commit to the conclusions in the Espoo Convention.
It is important to underline that the joint efforts of the Parties concerned to implement the Espoo Convention should firmly aim to strengthen the preventive regime established under the Convention. .
Finally, the issue of the bilateral and primarily political Nord Stream project should be settled through respecting the rightful interests of all states around the Sea andcertainly not before the Russian Government joins the Espoo Convention.
This would be in line with Article 2 paragraph 7 of the Espoo Convention, with the decision II/9 of the Sofia Meeting of the Parties to prepare a protocol on Strategic Environmental Assessment for adoption at the 5th Ministerial Conference in Kiev, Ukraine, in May 2003, as well as with the new directive 2001/42.
So the Belarus authorities have been defiant about the need to properly inform Belarus's neighbours about the planned project, andthe project as it stands clearly violates the Espoo Convention on environmental impact assessment.
The aim of the recommendations is to assist the parties in the consistent practical implementation of the United Nations ESPOO Convention on Environmental Impact Assessment in a Transboundary Context(the Espoo Convention) in the field of nuclear energy through Illustrate good practices and exchange of experiences.
It is not Swedish territory that is affected by this, but Sweden's economic zone, and therefore we have been very careful to point out that it is international conventions, like the Espoo Convention, that form the basis for the positions we are to adopt.
As implied above,the joint efforts of the two countries to implement the Espoo Convention should move towards the direction of streamlining the public participation provisions of their national legal systems, at least in the field of transboundary EIAs, so as to ensure reciprocity and equal treatment and give effect to relevant emerging international and EC standards.
(c) May the security of the country's electricity supply constitute an overriding reason of public interest permitting a derogation from the application of Articles 2 to 6 of the Espoo Convention or suspension of the application of those provisions?
To sum up: In order to fully implement the Espoo Convention and to organize effective transboundary EIA procedures, Greece and Bulgaria should consider the possibility of concluding a bilateral EIA agreement, establishing a joint EIA committee and incorporating into their national legal systems also those EC provisions, which have a direct transboundary relevance.
Neither Russia nor Belarus have conducted environmental impact assessments on these power plants in accordance with generally accepted international standards,as called for in the Espoo convention, to which all EU Member States are signatories.
The report also calls on the Turkish Government to“halt its plans for the construction of the Akkuyu nuclear power plant” andrequests that the Turkish Government joins the Espoo Convention and asks the Turkish Government to involve, or at least consult, the governments of its neighbouring countries, such as Greece and Cyprus, in relation to any further developments in the Akkuyu venture.
For projects likely to have significant adverse cross-border environmental impacts in one or more neighbouring Member States,where Article 7 of Directive 85/337/EEC and the Espoo Convention are applicable, the relevant information shall be made available to the competent authority of the neighbouring Member State(s).
