The average disbursement rate reflects the establishment of additional FEIs in 2012.
In total, 940 FEIs had been set up in 25 Member States with an endowment of around €12.6 billion.
This average reflects the fact that the majority of FEIs where established in 2009 or later.
Audit authorities and the Commission may carry out thematic audits,for example on FEIs.
Funds implementing FEIs receive a contribution from the OP once their legal structure is set up.
In their joint audit strategy, DG REGIO andDG EMPL have planned thematic audits on FEIs.
These FEIs are designed to have a revolving character or, for certain types of guarantee funds, to achieve a high leverage effect.

Article 44 of Council Regulation(EC)No 1083/2006 does not require the Member States to provide such detailed data on FEIs to the Commission.
Notes that disbursement rates to final recipients reported varied widely between FEIs, with variations not only between Member States ranging from 60% to 99%, but also between areas of intervention;
According to the regulations, only the payments or guarantees provided to final recipients are considered eligible andunused endowments of FEIs are to be returned to the EU budget at closure(27).
The Court's analysis takes into account only the implementation report on FEIs for which figures were inserted in the column II.10 Amounts of OP contributions paid to FEI- national private co-financing.
The modification decision on the closure guidelines of the Commission does not affect Article 56(1),according to which the contribution from the funds into FEIs must have been paid at latest at 31 December 2015.
Financial contributions from the OPs to funds imple menting FEIs for the whole period are generally made through a single payment as soon as the legal structure of the holding fund has been set up.
Recommendation 4: propose an amendment to the structural funds regulations for the current programming period, in order torequire Member States to report on the financial implementation of FEIs.

As mentioned in its reply to paragraph 4.35,the Commission has proposed an audit approach to audit authorities that includes the testing of implementation of FEIs through the audit of a sample of projects carried out.
Nevertheless, the Commission obtained information on payments made to funds implementing FEIs from the managing authorities bythe end of 2010, on a voluntary basis, to estimate progress of FEIs in supporting businesses.
For the 2010 final accounts, on the basis of information provided by the Member States,the Commission reclassified part of the amounts reimbursed to Member States for FEIs as pre-paid expenditure(see Commission reply to Chapter 1, paragraphs 1.33 to 1.36).
Based on the estimation of the amounts not used by FEIs as at 31 December 2010, the most significant adjustments to be made were a reclassification from expenses to assets in the 2009 and 2010 accounts(see notes 2.5, 2.9, 2.10 and 3.4 to the 2010 accounts explaining the adjustments made).
