In order to avoid undue duplication of control, the competent authority shall take into account the oversight and supervision of the clearing andsettlement system already exercised by the central banks as overseers of clearing and settlement systems or by other supervisory authorities with competence in relation to such systems.
Where a supervisory authority does not comply within one month with the obligation laid down in paragraph 2, the other supervisory authorities shall be competent to take a provisional measure on the territory of its Member State in accordance with Article 51(1).
(94) Each supervisory authority should be provided with the adequate financial and human resources, paying particular attention to ensuring adequate technical and legal skills of staff, premises and infrastructure, which is necessary for the effective performance of their tasks,including for the tasks related to mutual assistance and co-operation with other supervisory authorities throughout the Union.
Due to the good cooperation between FSC and the other supervisory authorities from the EU Member States, the Project was supported by experts from the Federal Financial Supervisory Authority of Germany(BaFin) and the Securities Markets Commission of Spain(CNMV), who fulfilled successfully a part of the activities under component two.
Where a joint operation is intended and a supervisory authority does not, within one month,comply with the obligation laid down in the second sentence of paragraph 2 of this Article, the other supervisory authorities may adopt a provisional measure on the territory of its Member State in accordance with Article 55.
(4) The Bank may, not more than once a year, request the other supervisory authorities, to derogate from the criteria set out in paragraph(3) where their application would be inappropriate, taking into account the structure of the group and the relative importance of the activities of the insurance undertakings or reinsurance undertakings in different countries, and designate a different supervisory authority as group supervisor.
Through its involvement in national and international working groups(e.g. the Article 29 Working Party, the Berlin Group, the Conference of Data Protection andPrivacy Commissioners, other supervisory authorities for privacy protection, etc.), and through its contacts with similar organisations abroad, it participates in decision-making in the area of privacy protection.
Without prejudice to the rights andduties allocated by this Directive to the group supervisor and to other supervisory authorities, the coordination arrangements may entrust additional tasks to the group supervisor or the other supervisory authorities where this would result in the more efficient supervision of the group and would not impair the supervisory activities of the members of the college of supervisors in respect of their individual responsibilities.
In particular cases, the supervisory authorities concerned may, at the request of any of the other supervisory authorities, take a joint decision to derogate from the criteria set out in paragraph 2 where their application would be inappropriate, taking into account the structure of the group and the relative importance of the insurance and reinsurance undertakings' activities in different countries, and designate a different supervisory authority as group supervisor.
