In the absence of measures adopted at Union level, those disparities are likely to increase over the coming years, also taking into account the rapid expansion of the market for electronic cigarettes and refill containers.
Member States shall require manufacturers, importers anddistributers of electronic cigarettes and refill containers to establish and maintain a system for collecting information about all of the suspected adverse effects on human health of these products.
In addition, pursuant to Article 20(5)(e) of Directive 2014/40/EU on the manufacture, presentation and sale of tobacco and related products 7,the prohibitions applicable to communications concerning tobacco products under the AVMSD also apply to electronic cigarettes and refill containers.
As regards whether those measures are strictly necessary,it should be noted that that provision does not impose a prohibition on the cross-border sale of electronic cigarettes and refill containers, but leaves it to the discretion of the Member States to prohibit such sales or to allow them under certain conditions.
By allowing the Member States to prohibit the cross-border distance sales of electronic cigarettes and refill containers and by imposing certain common rules on the Member States which do not prohibit those sales, the measures laid down in Article 20(6) of Directive 2014/40 are appropriate for the purpose of achieving the objective identified in paragraph 122 of the present judgment.
(f) Given that nicotine is a toxic substance and considering the potential risks also to those for whom the product is not intended,nicotine-containing liquid should be placed on the market in electronic cigarettes or in refill containers that meets certain safety and quality requirements.
In addition, the Court points out that,taking into account the growing market for electronic cigarettes and refill containers, the national provisions governing the conditions which those products must satisfy are in themselves liable, in the absence of harmonisation at Union level, to constitute obstacles to the free movement of goods.
(41) In view of the fact that nicotine is a toxic substance and considering the potential health and safety risks, including to persons for whom the product is not intended,nicotine-containing liquid should only be placed on the market in electronic cigarettes or in refill containers that meet certain safety and quality requirements.
In addition, the Court rejects the argument that the obligation on manufacturers andimporters of electronic cigarettes and refill containers to submit each year, to the competent authorities of the Member States, certain data enabling those authorities to monitor the development of the market infringes the principles of proportionality and legal certainty.
As regards commercial communications concerning tobacco and related products in video-sharing platforms, the existing prohibitions provided for in Directive 2003/33/EC of the European Parliament and of the Council,as well as the prohibitions applicable to communications concerning e-cigarettes and refill containers pursuant to Directive 2014/40/EU of the European Parliament and of the Council, ensure that consumers are sufficiently protected.
It should be observed, next, that the data which the manufacturers andimporters of electronic cigarettes and refill containers must provide under Article 20(7) of Directive 2014/40, namely the sales volumes and mode, the preferences of various consumer groups, the main types of existing users and summaries of any relevant market surveys carried out, directly relate to their business activities, with the result that they are better placed to provide those data.
Changes in the Transitional and Final Provisions of the Health Act enact a ban on the sale and supply to children of:electronic cigarettes; refill containers; liquids containing nicotine; smoking articles other than tobacco; and water pipe products, not containing tobacco.
The Court also notes that,by allowing the Member States to prohibit the cross-border distance sales of electronic cigarettes and refill containers and by imposing certain common rules on the Member States which do not prohibit those sales, the directive enables the Member States to ensure that the rules on conformity are not circumvented.
