UK road haulage operators may, under the conditions laid down in this Regulation, conduct authorised carriage.
Other directives have applied the same principle to other professions, such as road haulage operators, insurance agents and brokers, hairdressers and architects.
United Kingdom road haulage operators may, under the conditions laid down in this Regulation, conduct permitted carriage of goods.
The additional examination shall cover the specific knowledge relating to the national aspects of the occupation of road haulage operator in the first Member State.
The occupation of road haulage operator" shall mean the activity of any undertaking transporting goods for hire or reward by means of either a motor vehicle or a combination of vehicles;'.
The occupation of road transport operator' means the occupation of road passenger transport operator or the occupation of road haulage operator;
United Kingdom road haulage operator' means an undertaking established in the United Kingdom which is permitted to engage in the carriage of goods by road and holds a valid United Kingdom licence;
The completion of an internal market in road transport with fair conditions of competition requires the uniform application of common rules on admission to the occupation of road haulage operator or road passenger transport operator(the occupation of road transport operator). .
Union road haulage operator' means an undertaking, engaged in the carriage of goods by road, which holds a valid Community licence, in accordance with Article 4 of Regulation(EC) No 1072/2009;
The Commission has also adopted a proposal for a Regulation to allow UK operators to temporarily(nine months) carry goods into the EU,provided the UK confers equivalent rights to EU road haulage operators and subject to fair competition conditions.
United Kingdom road haulage operator' means an undertaking established in the United Kingdom which is permitted to engage in the carriage of goods by road and holds a valid United Kingdom licence;
The completion of an internal market in road transport with fair conditions of competition requires the uniform application of common rules on admission to the occupation of road haulage operator or road passenger transport operator(the occupation of road transport operator). .
Admission to the occupations of road haulage operator or road passenger transport operator shall be governed by the provisions adopted by the Member States in accordance with the common rules contained in this Directive.
(2) So far, and unless otherwise provided for in national law,the rules on access to the occupation of road transport operator do not apply to undertakings engaged in the occupation of road haulage operator solely by means of motor vehicles with a permissible laden mass, including that of trailers, not exceeding 3.5 tonnes.
Concentrations between road haulage operators or coach and bus service operators, respectively, which significantly impede effective competition, in particular as a result of the creation or strengthening of a dominant position;
(2) So far, and unless otherwise provided for in national law,the rules on access to the occupation of road transport operator do not apply to undertakings engaged in the occupation of road haulage operator solely by means of motor vehicles with a permissible laden mass not exceeding 3.5 tonnes or combinations of vehicles not exceeding that limit.
(a) undertakings engaged in the occupation of road haulage operator solely by means of motor vehicles or coupled combinations of vehicles the permissible laden mass of which does not exceed 3,5 tonnes and that are engaged exclusively in national transport operations;'.
Article 3(1)(b) and(d) and Articles 4, 6, 8, 9, 14, 19 and21 shall not apply to undertakings engaged in the occupation of road haulage operator solely by means of motor vehicles with a permissible laden mass not exceeding 3.5 tonnes or combinations of vehicles with a permissible laden mass not exceeding 3.5 tonnes.
Agreements between road haulage operators or coach and bus service operators, respectively, decisions by associations of road haulage operators or by coach and bus service operators, and concerted practices which have as their object or effect the prevention, restriction or distortion of competition;
EU legislation is necessary to ensure a uniform application by Member States of the criteria used to authorise access to the occupation of road haulage operator or road transport operator, and in this way favour the completion of an internal market in road transport with fair conditions of competition.
(10) Undertakings engaged in the occupation of road haulage operator solely by means of motor vehicles with a permissible laden mass not exceeding 3.5 tonnes or with combinations of vehicles not exceeding that limit should have a minimum level of financial standing, to ensure that they have the means to carry out operations on a stable and long-lasting basis.
(a) the number of authorisations granted to operators engaged in the occupation of road haulage operator solely by means of motor vehicles with a permissible laden mass, including that of trailers, between 2.4 and 3.5 tonnes involved in international transport;
(10) Undertakings engaged in the occupation of road haulage operator solely by means of motor vehicles with a permissible laden mass, including that of trailers, between 2.4 and 3.5 tonnes and engaged in international transport operations, should have a minimum financial standing, to ensure that they have the means to carry out operations on a stable and long-lasting basis.
In order toprevent abuses by undertakings contracting transport services from road haulage operators, Member States should also provide for sanctions on shippers and freight forwarders in case they knowingly commission transport services which involve infringements of the provisions of Regulation(EC) No 1072/2009.
United Kingdom licence' means, when issued to a United Kingdom road haulage operator, a licence issued by the United Kingdom for the purposes of international carriage in respect of permitted carriage of goods and, when issued to a United Kingdom coach and bus service operator, a licence issued by the United Kingdom for the purposes of international carriage in respect of a permitted carriage of passengers by coach and bus;
In the context of carriage of goods between the territory of the Union andthe territory of the United Kingdom undertaken by a Union road haulage operator that relies on rights granted by the United Kingdom, as referred to in Article 7 of this Regulation, equivalent to those granted under this Regulation, Regulation(EC) No 1072/2009 shall apply to the part of the journey on the territory of the Member State of loading or unloading.
Where it determines that the rights granted by the United Kingdom to Union road haulage operators are not, de jure orde facto, equivalent to those granted to UK road haulage operators under this Regulation, or that those rights are not equally available to all Union road haulage operators, the Commission may, in order to restore equivalence, by means of delegated acts.
In order toprevent abuses by undertakings contracting transport services from road haulage operators, Member States should also provide for sanctions on consignors, shippers, freight forwarders, contractors and subcontractors where they know that the transport services that they commission involve infringements of the provisions of Regulation(EC) No 1072/2009.
Articles 4, 9, and14 shall not apply to undertakings engaged in the occupation of road haulage operator solely by means of motor vehicles with a permissible laden mass not exceeding 3,5 tonnes or combinations of vehicles with a permissible laden mass not exceeding 3,5 tonnes except where those vehicles undertake international carriage as defined by Regulation(EC) No 1072/2009.
Council Directive 96/26/EC of 29 April 1996 on admission to the occupation of road haulage operator and road passenger transport operator and mutual recognition of diplomas, certificates and other evidence of formal qualification intended to facilitate for these operators the right of freedom of establishment for national and international transport operations.
