Holding: any establishment(agricultural or other), situated in the territory of a Member State, in which animals are kept or bred;
Directive 2008/101 provides that Directive 2003/87 is to apply to flights which arrive at ordepart from an aerodrome situated in the territory of a Member State.

In the light of the question submitted by the referring court, it should be noted, first of all, that, as set out in Article 3(1)(a) of Regulation No 261/2004, the regulation is applicable to passengers departing from an airport situated in the territory of a Member State.
Aviation Flights which depart from orarrive in an aerodrome situated in the territory of a Member State to which the Treaty applies.
It follows that Article 7(1) of the Open Skies Agreement does not preclude the application of the allowance trading scheme set up by Directive 2003/87 to operators of aircraft, such as airlines established in the United States, when their aircraft engage in flights which arrive at ordepart from an aerodrome situated in the territory of a Member State.
From 1 January 2012, all flights which arrive at ordepart from an airport situated in the territory of a Member State to which the Treaty applies shall be included”.
Secondly, the first of those flights departed from an airport situated in the territory of a Member State, whereas the second departed from and arrived at airportssituated in the territory of a third State. .
All flights performed during the period covered by the report which fall within the aviation activities listed in Annex I for which it is the aircraft operator andwhich departed from an airport situated in the territory of a Member State and arrived at an airport situated in the territory of the same Member State; .
(b) to passengers departing from an airport located in a third country to an airport situated in the territory of a Member State to which the Treaty applies, unless they received benefits or compensation and were given assistance in that third country, if the operating air carrier of the flight concerned is a Community carrier.
(r)‘attributed aviation emissions' means emissions from all flights falling within the aviation activities listed in Annex I which depart from an aerodrome situated in the territory of a Member State and those which arrive in such an aerodrome from a third country;
Assistance given at ports situated in the territory of a Member State should, among other things, enable disabled persons and persons with reduced mobility to proceed from a designated point of arrival at a port to a passenger ship and from a passenger ship to a designated point of departure at a port, including embarking and disembarking.
Articles 3, 4 and10 shall also apply to passengers departing from an airport situated in a third country to an airport situated in the territory of a Member State to which the Treaty applies, if the operating carrier is a Community air carrier.
Assistance given at airports situated in the territory of a Member State to which the Treaty applies should, among other things, enable disabled persons and persons with reduced mobility to proceed from a designated point of arrival at an airport to an aircraft and from the aircraft to a designated point of departure from the airport, including embarking and disembarking.
On passenger services where the port of embarkation is outside the territory of an EU Member State andthe port of disembarkation is situated in the territory of a Member State, provided that the service is operated by a Union carrier.
It follows that the European Union had competence, in the light of the principles of customary international law capable of being relied upon in the context of the main proceedings, to adopt Directive 2008/101, in so far as the latter extends the allowance trading scheme laid down by Directive 2003/87 to all flights which arrive at ordepart from an aerodrome situated in the territory of a Member State.
To passengers departing from an airport located in a third country to an airport situated in the territory of a Member State, unless they received benefits or compensation, if the operating air carrier of the flight concerned is a Community carrier.
Article 3(1) of the Regulation limits its scope to passengers departing from an airport located in the territory of a Member State to which the Treaty applies andto passengers departing from an airport located in a third country to an airport situated in the territory of a Member State to which the Treaty applies if the operating air carrier is an EU carrier.
Where the cruise ship comes from a port situated in a third country andcalls for the first time at a port situated in the territory of a Member State, crew and passengers shall be subject to entry checks on the basis of the nominal lists of crew and passengers, as referred to in point 3.2.4.
In accordance with Article 3(1)(a), passengers who missed a connection within the EU, or outside the EU with a flight coming from an airport situated in the territory of a Member State, should be entitled to compensation, if they arrived at final destination with a delay of more than three hours.
Where the cruise ship comes from a port situated in a third country andcalls again at a port situated in the territory of a Member State, crew and passengers shall be subject to entry checks on the basis of the nominal lists of crew and passengers as referred to in point 3.1.2. to the extent that those lists have been modified since the cruise ship called at the previous port situated in the territory of a Member State.
It is only if the operator of such an aircraft has chosen to operatea commercial air route arriving at or departing from an aerodrome situated in the territory of a Member State that the operator, because its aircraft is in the territory of that Member State, will be subject to the allowance trading scheme.'.
