Smart tachographs are supposed to control the working time of drivers even better.
From June 15, 2019, each new vehicle performing transport services within the European Union will have to be equipped with the so-called smart tachograph.
First of all, smart tachographs of the second generation will monitor the moment of crossing the state border.
The Commission should explore the possibility of setting up a road transport portal, such as GNSS,which would allow national authorities to fully exploit the potential of the smart tachograph.
The smart tachograph will contribute to simplified controls and thus facilitate the work of national authorities.
In this regard, the Rapporteur is convinced that the mandatory use of smart tachographs in international transport must be introduced earlier than is foreseen by current regulation.
Smart tachographs represent an opportunity to enable fast, interoperable digital controls and enforcement of rules.
There is also a need to incentivise the use of the smart tachograph and increase the exchange of best practices and training between Member States on enforcement.
The Commission will analyse the roles and responsibilities of the European C-ITS Trust Model, and whether some operational functions andgovernance roles should be taken over by the Commission(as, for instance, in the case of the Smart Tachograph 24).
The smart tachograph shall be introduced on a mandatory basis on all vehicles engaged in international transport and cabotage by the 2nd January 2020, at the latest.
(c) carries out international transport carriage with vehicles equipped with a smart tachograph as laid down in Article 3 and Chapter II of Regulation(EU) No 165/2014 of the European Parliament and of the Council1a.'.
The smart tachograph, which indicates the location of drivers over the span of a 56-day period, shall be introduced on all vehicles engaged in international transport and cabotage by 2 January 2020.
In order tofacilitate the verification of compliance by control authorities, the smart tachograph shall also record, if the vehicle has been employed for the carriage of goods or passengers, as required by Regulation(EC) No 561/2006.
The smart tachograph will contribute to the better monitoring of the application of Union law in the road transport sector and to simplified checks, and will thus facilitate the work of national authorities.
(11a) The rapid development of new technologies and digitalisation throughout the Union economy andthe need for a level playing field among companies in international road transport make it necessary to shorten the transitional period for the installation of the smart tachograph in registered vehicles.
The installation of the smart tachograph in registered vehicles should be provided for as an obligation as soon as possible and no later than January 2021.
Further, the Commission wants to improve the cooperation between Member States via rules on exchange of information, enable targeted checks by providing risk rating via the European Register for Road Undertakings andfurther encourage the use of the smart tachograph and e-documents.
(15 a) The swift introduction of the smart tachograph is of paramount importance, as it will enable enforcement authorities carrying out roadside checks to detect infringements and abnormalities quicker and more efficiently, which would result in better enforcement of this Regulation.
The report shall include an evaluation of the use of autonomous driving systems in the Member States and the possibility for the driver to record the period during which an autonomous driving system is activated and shall be accompanied, if appropriate, by a legislative proposal to amend this Regulation,including the necessary requirements for the driver to record those data in the smart tachograph.".
International carriage shall be carried out subject to the possession of a smart tachograph as stipulated in Chapter II of Regulation(EU) No 165/2014 of the European Parliament and of the Council1a, a Community licence and, if the driver is a national of a third country, in conjunction with a driver attestation.
The report shall include an evaluation of the use of autonomous driving systems in the Member States and the possibility for the driver to record the period during which an autonomous driving system is activated and shall be accompanied, if appropriate, by a legislative proposalto amend this Regulation, including the necessary requirements for the driver to record those data in the smart tachograph.".
For the purpose of paragraph 2, Member States shall have access to relevant information anddata recorded, processed or stored by the smart tachograph referred to in Chapter II of Regulation(EU) No 165/2014 and in electronic transport documents, such as electronic consignment notes under the Convention on the Contract for the International Carriage of Goods by Road(eCMR).
