General conditions for use of nutrition and health claims.
The use of nutrition and health claims will only be permitted if the following conditions are fulfilled.
In December 2006, the European Union adopted a Regulation on the use of nutrition and health claims for foods.
The use of nutrition, which includes monocalcium phosphate, provides greater energy value, biologic and economic benefits.
In December 2006 EU decision makers adopted Regulation(EC) No 1924/2006 on the use of nutrition and health claims for foods.
In Europe the use of nutrition and health claims is regulated by the European Food Safety Authority(EFSA) and today there are no approved health claims for probiotics.
Without prejudice to Directives 2000/13/EC and 84/450/EEC, the use of nutrition and health claims shall not.
The use of nutrition and health claims shall only be permitted if the average consumer can be expected to understand the beneficial effects as expressed in the claim.
The European Union, introduced a regulation on the use of nutrition and health claims for such foods in December 2006.
This Regulation on nutrition and health claims complements the general principles in Regulation(EU) No.1169/2011 andlays down specific provisions concerning the use of nutrition and health claims concerning foods to be delivered as such to the consumer.
Other general conditions include a requirement that the use of nutrition and health claims shall only be permitted if the average consumer can be expected to understand the beneficial effects as expressed in the claim.
It is therefore necessary to adopt Community rules on the use of nutrition and health claims on foods.
In December 2006 the EU adopted a Regulation on the use of nutrition and health claims for foods which lays down harmonised EU-wide rules for the use of health or nutritional claims on foodstuffs based on nutrient profiles.
In the words of point(a)of the second paragraph of Article 3 of Regulation No 1924/2006, the use of nutrition and health claims is not to be false, ambiguous or misleading.
Whereas, as stated in Article 5(2) of Regulation(EC) No 1924/2006, the use of nutrition and health claims can only be permitted if the average consumer can be expected to understand the beneficial effects as expressed in the claim;
By 19 January 2009, the Commission shall establish specific nutrient profiles, including exemptions, which food or certain categories of food must comply with in order to bear nutrition orhealth claims and the conditions for the use of nutrition or health claims for foods or categories of foods with respect to the nutrient profiles.

Parallel with all this, Article 4 requires that by 19 January 2009, the Commission shall establish specific nutrient profiles, including exemptions, which food or certain categories of food must comply with in order to bear nutrition orhealth claims and the conditions for the use of nutrition or health claims for foods or categories of foods with respect to the nutrient profiles.
An important aspect of this proposed legislationis that it states, in article 5.2, ‘the use of nutrition and health claims shall only be permitted if the average consumer can be expected to understand the beneficial effects expressed in the claim’.
Article 4 requires that by 19 January 2009, the Commission shall establish specific nutrient profiles, including exemptions, which food orcertain categories of food must comply with in order to bear nutrition or health claims and the conditions for the use of nutrition or health claims for foods or categories of foods with respect to the nutrient profiles.

Whereas, as stated in Article 3 of Regulation(EC)No 1924/2006, the use of nutrition and health claims must not be false, ambiguous or misleading;
This Regulation should complement the general principles in Directive 2000/13/EC andlay down specific provisions concerning the use of nutrition and health claims concerning foods to be delivered as such to the consumer.
