(c) amend the statement of the wares or services in respect of which the trade-mark is registered;

Use", in relation to a trade-mark, means any use that by section 4 is deemed to be a use in association with wares or services;

(2) An application to extend the statement of wares or services in respect of which a trade-mark is registered has the effect of an application for registration of the trade-mark in respect of the wares or services specified in the application for amendment.
A trade-mark is deemed to be made known in Canada by a person only if it is used by that person in a country of the Union, other than Canada,in association with wares or services, and.
The owner of a registered certification mark may prevent its use by unlicensed persons or in association with any wares or services in respect of which the mark is registered but to which the licence does not extend.
(c) an entity that is licensed by or with the authority of the applicant to use the trade-mark, if the applicant has direct or indirect control of the character or quality of the wares or services.
In relation to a trade-mark,means a trade-mark that actually distinguishes the wares or services in association with which it is used by its owner from the wares or services of others or is adapted so to distinguish them;
A trade-mark, whether registered or unregistered, is transferable, and deemed always to have been transferable, either in connection with or separately from the goodwill of the business and in respect of either all or some of the wares or services in association with which it has been used.
Subject to sections 21, 32 and 67, the registration of a trade-mark in respect of any wares or services, unless shown to be invalid, gives to the owner of the trade-mark the exclusive right to the use throughout Canada of the trade-mark in respect of those wares or services.
Certification mark" means a mark that is used for the purpose of distinguishing or so as to distinguish wares or services that are of a defined standard with respect to.
(2) The Registrar shall, having regard to the evidence adduced,restrict the registration to the wares or services in association with which the trade-mark is shown to have been so used as to have become distinctive and to the defined territorial area in Canada in which the trade-mark is shown to have become distinctive.
No person shall, during any period prescribed by the regulation, in association with a trade-mark or other mark, promote or otherwise direct public attention to their business, wares or services in a manner that misleadsor is likely to mislead the public into believing that.
For the purposes of this Act, to the extent that public notice is given of the fact that the use of a trade-mark is a licensed use and of the identity of the owner, it shall be presumed, unless the contrary is proven, that the use is licensed by the owner of the trade-mark andthe character or quality of the wares or services is under the control of the owner.
(g) the use by a person of their address, the geographical name of their place of business,an accurate indication of the origin of their wares or services, or an accurate description of their wares or services to the extent that the description is necessary to explain those wares or services to the public;
When an application for registration of a proposed trade-mark is allowed, the Registrar shall give notice to the applicant accordingly and shall register the trade-mark and issue a certificate of registration on receipt of a declaration that the use ofthe trade-mark in Canada, in association with the wares or services specified in the application, has been commenced by.
(2) The use of a trade-mark causes confusion with another trade-mark if the use of both trade-marks in the same area would be likely to lead to the inference that the wares or services associated with those trade-marks are manufactured, sold, leased, hired or performed by the same person, whether or not the wares or services are of the same general class.
The application in Canada, including or accompanied by a declaration setting out the date on which and the country of the Union in which the earliest application was filed for the registration of the same or substantially the same trademark for use in association with the same kind of wares or services, is filed within a period of six months from that date, which period shall not be extended;
Depicted, written or sounded, either clearly descriptive or deceptively misdescriptive in the English or French language of the character or quality of the wares or services in association with which it is usedor proposed to be used or of the conditions of or the persons employed in their production or of their place of origin;
Any applicant who has filed an application in accordance with section 30 for registration of a proposed trade-mark that is registrable is entitled,subject to sections 38 and 40, to secure its registration in respect of the wares or services specified in the application, unless at the date of filing of the application it was confusing with.
When depicted, written or sounded is either clearly descriptive or deceptively is mis-descriptive in the English or French language of the character or quality of the wares or services in association with which it is to be usedor proposed to be used or the conditions of or the person employed in their production or of their place of origin;
(1) A certification mark may be adopted and registered only by a person who is not engaged in the manufacture, sale,leasing or hiring of wares or the performance of services such as those in association with which the certification mark is used.
(b) the working conditions under which the wares have been produced or the services performed.
