(13a) The process of text and data mining includes downloading of protected works and other subject matter on a significant scale.
This Directive shall apply in respect of all works and other subject matter that are protected by national law in the field of copyright on or after[24 months after the date of entry into force of this Directive].
Whereas the advent of new technologies is likely to have an impact on both the quality and the quantity of the exploitation of works and other subject matter;
(3) Rapid technological developments continue to transform the way works and other subject matter are created, produced, distributed and exploited.
Accurate distribution is only possible where collecting societies maintain proper records of membership,licences and use of works and other subject matter.
Member States should for example remain free to require that the use of works and other subject matter should respect moral rights of authors and performers.
In the event that the research is carried out in the framework of a public private-partnership,the undertaking participating in the public private partnership should also have lawful access to the works and other subject matter.
That uncertainty affects the ability of rightholders to determine whether, and under which conditions, their works and other subject matter are used, as well as their ability to obtain appropriate remuneration for such use.
The uses of works and other subject matter under the exception or limitation provided for in Article 8(2) shall be deemed to occur solely in the Member State where the cultural heritage institution undertaking that use is established.
Rightholders shall have the right to grant licences for the non-commercial uses of the rights,categories of rights or types of works and other subject matter of their choice.
(16) The exception or limitation should cover digital uses of works and other subject- matter such as the use of parts or extracts of works to support, enrich or complement the teaching, including the related learning activities.
However, legal uncertainty remains, for both rightholders and users, as regards certain uses,including cross-border uses, of works and other subject matter in the digital environment.
Text and data mining' means any automated analytical technique which analyses works and other subject matter in digital form in order to generate information, including, but not limited to, patterns, trends and correlations.
The rights referred to in paragraph 1 shall not be exhausted by any sale orother act of distribution of originals and copies of copyright works and other subject matter as set out in Article 3(1).
(16) The exception orlimitation should cover digital uses of works and other subject- matter such as the use of parts or extracts of works to support, enrich or complement the teaching, including the related learning activities.
Member States shall ensure that authors and performers receive fair and proportionate remuneration for the exploitation of their works and other subject matter, including for their online exploitation.
Collecting societies managing different types of works and other subject matter, such as literary, musical or photographic works, should also allow this flexibility to rightholders as regards the management of works, different types of works and other subject matter.
Principle of fair and proportionate remuneration: Member States shall ensure that authors and performers receive fair and proportionate remuneration for the exploitation of their works and other subject matter, including for their online exploitation.
The exception or limitation provided for in paragraph 1 shall apply on condition that the use of works and other subject matter referred to in that paragraph has not been expressly reserved by their rightholders in an appropriate manner, such as machine readable means in the case of content made publicly available online.
For that purpose rightholders should provide the service providers taking into account, among other factors, the size of with necessary and relevant information rightholders and the type of their works and other subject matter.
Online content-sharing service providers shall inform their users in their terms and conditions that they can use works and other subject matter under exceptions or limitations to copyright and related rights provided for in Union law.
It also lays down rules on exceptions and limitations to copyright and related rights, on the facilitation of licences,as well as rules which aim to ensure a well-functioning marketplace for the exploitation of works and other subject matter.
Online content sharing service providers shall inform the users in their terms and conditions about the possibility for them to use works and other subject matter under exceptions or limitations to copyright and related rights provided for in Union law.
For the purposes of this Directive, works and other subject matter should be considered to be permanently in the collection of a cultural heritage institution when copies of such works or other subject matter are owned or permanently held by that institution, for example as a result of a transfer of ownership or a licence agreement, legal deposit obligations or permanent custody arrangements.
If no authorisation is granted,online content-sharing service providers shall be liable for unauthorised acts of communication to the public of copyright protected works and other subject matter, unless the service providers demonstrate that they have.
(29) For the purposes of this Directive, works and other subject matter should be considered to be permanently in the collection of a cultural heritage institution when copies of such works or other subject matter are owned or permanently held by that institution, for example as a result of a transfer of ownership or a licence agreement, legal deposit obligations or permanent custody arrangements.
Member States should remain free to adopt provisions on the interpretation, adaptation and further execution of contracts on the exploitation of protected works and other subject matter which were concluded before the extension of the term of protection resulting from this Directive.
Also, in the field of the use of works and other subject matter in teaching activities(Article 4), the Rapporteur believes that the exception should benefit not only all formal educational establishments in primary, secondary, vocational and higher education, but also other organisations such as libraries and other cultural heritage institutions, providing non-formal or informal education.
Where no authorisation has been granted to service providers,they should make their best efforts in accordance with high industry standards of professional diligence to avoid the availability on their services of unauthorised works and other subject matter, as identified by the relevant rightholders.
However, the particular characteristics of the collections of out-of-commerce works or other subject matter,together with the amount of works and other subject matter involved in mass digitisation projects, mean that obtaining the prior authorisation of the individual rightholders can be very difficult.
