Chapter III of the Euratom Treaty headed"Health and Safety" is the legal basis for the three directives that are potentially relevant, Directive 89/618/Euratom on informing the public in the event of radiological emergency, Directive 96/29/Euratom on basic safety standards andDirective 92/3/Euratom on the supervision and control of shipments of radioactive waste.

The time is now ripe to amend the existing 1992 Directive on the Supervision and Control of Shipments of Radioactive Waste and Nuclear Spent Fuel in line with the development of contemporary society, which is exactly what the Commission proposal does.
Firstly, I wish to express my support for the efforts of the Community to strengthen the supervision and control of shipments of radioactive waste within the EU.
Mr President, Commissioner, ladies and gentlemen,the Commission's proposal on the directive concerning the control of shipments of radioactive waste is balanced and takes account of many of the suggestions made by Parliament during the debate on the previous proposal.
Within the European Union information to Member States and the Commission on the shipment of radioactive waste is ensured through the following two provisions: first,Council Directive 92/3 relates to the supervision and control of shipments of radioactive between Member States and into and out of the Community.
To supplement existing provisions,the Council adopted on 3 February 1992 a Directive on the supervision and control of shipments of radioactive waste between Member States and into and out of the Community, based in particular on Articles 31 and 32 of the Euratom Treaty.
The Com mission delivered a positive report concerning the implementation into national law of Directive 92/3/Euratom on the supervision and control of shipments of radioactive waste between Member States, in and out of the EU.
Specific provisions are provided for bythe CouncU Directive 92/3/EURATOM(') on the supervision and control of shipments of radioactive waste between Member States and into and out of the Community.

The next item is the report(A6-0174/2006) by Mr Seppänen, on behalf of the Committee on Industry, Research and Energy,on the proposal for a Council directive on the supervision and control of shipments of radioactive waste and nuclear spent fuel COM(2005)0673 C6-0031/2006 2005/0272CNS.
The relevant legal provisions with regard to the transfer of radioactive waste between Member States are set forth in Council Directive 92/3/Euratom of 3 February 1992 on the supervision and control of shipments of radioactive waste between Member States and into and out of the Community.
Following the Council of Environment Ministers October 1992 agreement on the Regulation on the supervision and control of shipments of waste within, into and out of the European Community, what action will it now take to similar supervision and control on shipments of radioactive waste within, into and out of the EC?
This competence enables the Commission to ensure that Member States first inform the public of potential risks and the steps that should be taken should a radiological emergency occur; andsecond, adequately control and supervise shipments of radioactive waste.
Controls of shipments of sealed sources, other relevant sources and radioactive waste between Member States, pursuant to Community or national law, for the purpose of radiation protection shall be performed as part of the control procedures applied in a non-discriminatory manner throughout the territory of the Member State.
Whereas the management of radioactive waste necessitates supervision and control including a compulsory and common notification procedure for shipments of such waste;
Whereas Council Directive 84/631/EEC of 6 December 1984 on the supervision and control within the European Community of the transfrontier shipment of hazardous waste(8) does not apply to radioactive waste;
