Where the Commission finds that a third country does not ensure an adequate level of protection within the meaning of paragraph 2, the MS should take the measures necessary to prevent any transfer of data of the same type to the third country in question.
MS and the Commission have an equal role toplay in identifying cases in which a third country does not ensure an adequate level of protection.
It is apparent, in particular,from that article that the finding that a third country does or does not ensure an adequate level of protection may, as the Advocate General has observed in point 86 of his Opinion, be made either by the Member States or by the Commission.
The Union institutions and bodies shall inform the Commission and the European Data Protection Supervisor of cases where they consider the third country orinternational organisation in question does not ensure an adequate level of protection within the meaning of paragraph 1.

(169) The Commission should adopt immediately applicable implementing acts where the available data reveals that third country,soil or specific sector in the third country or international body does not ensure an adequate level of protection and require compelling urgency.

The Community legislature thus laid down the rule that‘thetransfer of personal data to a third country which does not ensure an adequate level of protection must be prohibited'.

By way of derogation from Article 25 and save where otherwise provided by domestic law governing particular cases, Member States shall provide that a transfer ora set of transfers of personal data to a third country which does not ensure an adequate level of protection within the meaning of Article 25(2) may take place on condition that:.

Art 28 of the Directive, read in light of arts 7 and 8 of the Charter, must be interpreted as meaning that the existence of a Commission decision based on art 25(6) of that Directive does not have the effect of preventing a national authority frominvestigating a complaint alleging that a third country does not ensure an adequate level of protection of the personal data transferred and, where necessary, suspending the data transfer.
Products that do not ensure an adequate level of protection can currently reach the market without a clear indication of their quality, and the level playing field is thereby impaired.

These concern products on the market that do not ensure an adequate level of protection, diverging approaches of the notified bodies, the effectiveness of the market surveillance as well as risks related to protective equipment which is currently not covered by the PPE Directive.
As is apparent from the referring court's explanations relating to the questions submitted, Mr Schrems contends in the main proceedings that United States law andpractice do not ensure an adequate level of protection within the meaning of Article 25 of Directive 95/46.
Any applicable data protection safeguards, as may be amended or replaced,for the transfers of data to Controllers established outside of the EU/EEA that do not ensure an adequate level of protection("Standard Contractual Clauses").
