Importers who consider or have reason to believe that a vehicle, system, component or separate technical unit which they have sold registered orare responsible for the entry into service is not in conformity with this Regulation shall immediately take the corrective measures necessary to bring that vehicle, system, component or separate technical unit into conformity, to withdraw it or to recall it, as appropriate.
That prohibition shall not apply to products of animal origin listed in Annex VIII, Chapter C, and fulfilling the requirements of Annex VIII,Chapter C. They must be accompanied by an animal health certificate issued by an official veterinarian certifying that they have been produced in conformity with this Regulation.
Distributors who consider or have reason to believe that a vehicle, system, component or separate technical unit which they have sold or registered or for which they are responsible forthe entry into service, is not in conformity with this Regulation, shall make sure that the corrective measures are taken necessary to bring that vehicle, system, component or separate technical unit into conformity, to withdraw it or to recall it, as appropriate.
Without prejudice to paragraphs 1 and 2 of this Article and by way of derogation from Article 180 of Regulation(EC) No 1234/2007 and Article 3 of Council Regulation(EC) No 1184/200611, Articles 107, 108 and 109 of the Treaty shall not apply to payments made under Chapters III andIV of this Regulation by Greece in conformity with this Regulation.
A manufacturer who considers that a vehicle, system, component, separate technical unit, or part or equipment that has been placed on the market orentered into service is not in conformity with this Regulation or that the type approval has been granted on the basis incorrect data, shall immediately take the appropriate measures necessary to bring that vehicle, system, component, separate technical unit, part or equipment into conformity, to withdraw it from the market or to recall it, as appropriate.
However, and without prejudice to Article 89 of this Regulation, Articles 87, 88 and89 of the Treaty shall not apply to payments made by Member States pursuant to and in conformity with this Regulation within the scope of Article 36 of the Treaty.".
