This procedure is applicable to implementing measures of general scope intended to amend non-essential elements of a basic instrument adopted in accordance with the procedure referred to in Article 251 of the Treaty(i.e.‘co-decision'),including by deleting some of those elements or by supplementing them by the addition of new non-essential elements. .
Where a basic instrument, adopted in accordance with the procedure referred to in Article 251 of the Treaty, provides for the adoption of measures of general scope designed to amend non-essential elements of that instrument,inter alia by deleting some of those elements or by supplementing the instrument by the addition of new non-essential elements, those measures are to be adopted in accordance with the regulatory procedure with scrutiny.
The technical standards should determine the conditions of application of the rules included in basic instruments adopted by the European Parliament and the Council and, where applicable, in Commission implementing measures without amending non-essential elements of those acts,inter alia by deleting some of those elements or by supplementing the act by the addition of new non-essential elements. .
