(10) Note for guidance of the establishment of maximum residue limits for Salmonidae and other fin fish.
COMMISSION REGULATION(EEC) No 762/92 of 27 March 1992 modifying Annex V to Council Regulation(EEC)No 2377/90 laying down a Community procedure for the establishment of maximum residue limits of veterinary medicinal products in foodstuffs of animal origin.
(4) Regulation(EEC) No 2377/90 provides that the establishment of maximum residue limits shall in no way prejudice the application of other relevant Community legislation.
COMMISSION REGULATION(EC) No 748/97 of 25 April 1997 amending Annex I and II of Council Regulation(EEC)No 2377/90 laying down a Community procedure for the establishment of maximum residue limits of veterinary medicinal products in foodstuffs of animal origin.
Whereas Council Regulation(EEC) No 2377/90 of 26 June 1990 laying down a Community procedure for the establishment of maximum residue limits of veterinary medicinal products in foodstuffs of animal origin(9), and in particular Annexes I and III thereto, is applicable as regards the maximum residue levels for pharmacologically active substances in milk;
(i) in the case of veterinary medicinal products intended for food-producing species and containing pharmacologically active substances that have not been included in Regulation(EU) No 37/2010 for the animal species in question,a document certifying that a valid application for the establishment of maximum residue limits has been submitted to the Agency in accordance with Regulation(EC) No 470/2009.
Having regard to Council Regulation(EEC) No 2377/90 of 26 June 1990 laying down a Community procedure for the establishment of maximum residue limits of veterinary medicinal products in foodstuffs of animal origin(1), as last amended by Commission Regulation(EC) No 1942/1999(2), and in particular Articles 6, 7 and 8 thereof.
COUNCIL REGULATION(EC) No 434/97 of 3 March 1997 amending Regulation(EEC)No 2377/90 laying down a Community procedure for the establishment of maximum residue limits of veterinary medicinal products in foodstuffs of animal origin.
Having regard to Council Regulation(EEC) No 2377/90 of 26 June 1990 laying down a Community procedure for the establishment of maximum residue limits of veterinary medicinal products in foodstuffs of animal origin(1), as last amended by Commission Regulation(EC) No 804/1999(2) and in particular Articles 6, 7 and 8 thereof.
However, the date referred to in the previous subparagraph shall be deferred for substances the use of which was authorized on the date of entry into force of this Regulation andin respect of which documented applications for the establishment of maximum residue limits have been lodged with the Commission or with the European Agency for the Evaluation of Medicinal Products before 1 January 1996.

Whereas, in order to allow this Community procedure to continue on a sound scientific basis and not to deprive veterinary surgeons and users of substances needed to protect animal health,this time limit should be extended for substances for which documented applications for the establishment of maximum residue limits have been lodged with the Commission or with the European Agency for the Evaluation of Medicinal Products before 1 January 1996, or the period of extension differing according to the nature of the substance.
