Whereas it is therefore necessary to approximate these legislations;

(5) Accordingly, it is necessary to approximate these concepts, principles and procedures so as to form a common basis for measures governing food and feed taken in the Member States and at Community level.
Whereas in the Member States the construction and methods of control of ancillary equipment for liquid meters are subject to mandatory provisions which differ from one Member State to another and consequently hinder trade in such instruments;whereas it is therefore necessary to approximate these provisions;
(3) The prohibition of application or re-application of organostannic compounds directly affects the functioning of the internal market in organostannic compounds andit is therefore necessary to approximate the laws of the Member States in this field and consequently to amend Annex I to Directive 76/769/EEC and in particular, Directive 1999/51/EC.
Whereas in the Member States the construction and methods of control of medium accuracy rectangular bar and cylindrical weights are subject to mandatory provisions which differ from one Member State to another and consequently hinder trade in such weights;whereas it is therefore necessary to approximate these provisions;
It is therefore necessary to approximate the laws of the Member States in this field and, consequently, to amend Annex I to Council Directive 76/769/EEC of 27 July 1976 on the approximation of the laws, regulations and administrative provisions of the Member States relating to restrictions on the marketing and use of certain dangerous substances and preparations(4).
Whereas limitations already adopted or planned by certain Member States on the use of nickel directly affect the completion and functioning of the internal market;whereas it is therefore necessary to approximate the laws of the Member States in this field and consequently to amend Annex I to Directive 76/769/EEC(4).
Whereas in the various Member States construction and methods of control of checkweighing and weight grading machines are subject to mandatory provisions which differ from one Member State to another and consequently hinder trade in such instruments;whereas it is therefore necessary to approximate these provisions;

Whereas in several Member States the construction and the methods of control of pressure gauges intended to measure the inflation pressure of motor vehicle tyres are subject to mandatory provisions which differ from one Member State to another and consequently hinder trade in such instruments;whereas it is therefore necessary to approximate those provisions;
Whereas the limits imposed on Member States as regards the placing on the market of hexachloroethane for use in the non-ferrous metal industries directly affect the functioning of the internal market;whereas it is therefore necessary to approximate the laws of the Member States in this field and consequently to amend Annex I to Directive 76/769/EEC(4);
Whereas any disparity between the laws or administrative measures adopted by the Member States on the disposal of batteries and accumulators could create barriers to trade and distort competition in the Community and may thereby have a direct impact on the establishment and functioning of the internal market;whereas it therefore appears necessary to approximate the laws in the field;
Whereas the limits planned by one Member State on the marketing of certain aerosol generators intended for entertainment and decorative purposes directly affect the completion and functioning of the internal market;whereas it is therefore necessary to approximate the laws of the Member States in this field and consequently amend Annex I to Directive 76/769/EEC(6);
Whereas disparities between the provisions in force or being amended in the Member States as regards the control of pollution from industrial plants can create unequal conditions of competition and thereby directly affect the functioningof the common market; whereas it is therefore necessary to approximate legislation in this field pursuant to Article 100 of the Treaty;
Whereas restrictions already adopted by certain Member States on the marketing and use of the substances mentioned above or the preparations containing them directly affect the establishment and functioning of the internal market;whereas it is therefore necessary to approximate the laws of the Member States in this field and consequently amend Annex I to Council Directive 76/769/EEC(2);
Whereas any disparity between the provisions on the discharge of certain dangerous substances into groundwater already applicable or in preparation in the Member States may create unequal conditions of competition and thus directly affect the functioning of the common market;whereas it is therefore necessary to approximate laws in this field, as provided for in Article 100 of the Treaty;
Whereas restrictions already adopted by certain Member States on the use and marketing of the abovementioned substances or preparations containing them have a direct effect on the establishment and functioning of the internal market;whereas it is therefore necessary to approximate the laws of the Member States in this field and to amend Annex I to Directive 76/769/EEC(5), as last amended by Directive 89/678/EEC(6), accordingly.
Whereas any disparity between the provisions already applicable or in preparation in the various Member States concerning methods of measurement and the frequency of sampling and analysis for each parameter to determine the quality of surface water may create unequal conditions of competition andconsequently directly affect the functioning of the common market; whereas it is therefore necessary to approximate the laws in this field, under Article 100 of the Treaty;
Whereas restrictions which have already been imposed by certain Member States on the use of marketing of the abovementioned substances or of preparations containing those substances directly affect the establishment and operation of the internal market;whereas it is therefore necessary to approximate the laws of the Member States in this field and, consequently, to amend Annex I to Directive 76/769/EEC(4), as last amended by Directive 89/678/EEC(5);
Whereas any disparity between the provisions on the disposal of waste oils already applicable or in preparation in the various Member States may create unequal conditions of competition and thus directly affect the functioning of the common market;whereas it is therefore necessary to approximate laws in this field as provided for in Article 100 of the Treaty;
Whereas limitations on use or marketing already adopted by certain Member States in respect of the substances referred to above or of preparations containing them have a direct incidence on the establishment and functioning of the internal market;whereas it is therefore necessary to approximate the legislative provisions of the Member States in this field, and consequently to amend Annex I to Directive 76/769/EEC(1), as last amended by Directive 85/610/EEC(2);
Whereas the disparities between the laws in force in the various Member States with regard to the assessment of the environmental effects of public and private projects may create unfavourable competitive conditions and thereby directly affect the functioning of the common market; whereas, therefore,it is necessary to approximate national laws in this field pursuant to Article 100 of the Treaty;
