In the case specified in Article 4(2) of Regulation(EEC)No 3220/84, pig carcases shall be individually identified by any unalterable means.
This Regulation lays down detailed rules implementing Regulation(EEC)No 3220/84 determining the Community scale for grading pig carcases.
Such sluice-gate prices shall be derived from the sluice-gate price for pig carcases on the basis of the ratio fixed for such products under Article 10(4).
The prices referred to in paragraph 1 shall include the value of the unprocessed offal andanimal residues and shall be expressed in respect of 100 kg of cold pig carcases.
By way of derogation from paragraph 1, Member States may lay down that pig carcases shall not be marked if an official record is drawn up comprising for each carcase at least.
The market price for pig carcases in a Member State shall be equal to the average of the quotations for pig carcases recorded on the markets or quotation centres of that Member State listed in the Annex to Regulation(EEC) No 2123/89.
Having regard to Council Regulation(EEC) No 3220/84 of 13 November 1984 determining the Community scale for grading pig carcases(3), and in particular Article 5(1) thereof.
Article 3a of Regulation(EEC) No 2764/75 is replaced by the following:'Article 3a''Pig carcases'' shall be taken to mean carcases or half-carcases of domestic swine which have been bled and eviscerated and from which the bristles and hooves have been removed.
Before 1 August of each year a basic price shall be fixed, valid from 1 November of the same year, for meat of domestic swine in carcases or half-carcases(hereinafter called"pig carcases")of a standard quality defined with reference to a Community scale for grading pig carcases.
As regards the products listed in Article 1(1)(a) and(b), other than pig carcases, the levy shall be derived from the levy on pig carcases on the basis of the ratio within the Community of the prices for such products to the price for pig carcases. .
Whereas Commission Regulation(EEC) No 2806/79(5) provides for the exchange between the Member States and the Commission of certain information concerning prices in the pigmeat sector; whereas it should be amended in the light of Commission Regulation(EEC) No 2342/86 of 25 July 1986 on the marketing stage to which the average prices for pig carcases refers and laying down transitional rules for the application of Regulation(EEC) No 3220/84(6),which redefines the basis for determining the average market price for pig carcases;
Immediately after grading, pig carcases shall be marked in accordance with the grade designation provided for in Article 3 or in accordance with their estimated lean-meat content, provided that the latter marking enables the carcases to be assigned to the grades provided for in Article 3.
Whereas, for commercial reasons, several slaughterhouses are producing dehided pig carcases; whereas Member States should be authorized to provide for such a presentation on their territory;
Whereas quotations for pig carcases are to be determined in the Community as from 1 August 1986 in accordance with the Community scale for grading pig carcases as laid down by Council Regulation(EEC) No 3220/84(3); whereas, however, Member States may instead continue until 31 December 1988 to apply the scale determined by Council Regulation(EEC) No 2760/75(4);
By way of derogation from paragraph 1,Member States may lay down that pig carcases need not be marked if an official record is drawn up comprising for each carcase at least.
For products of standard quality other than pig carcases, buying-in prices shall be derived from the buying-in price for pig carcases on the basis of the ratio of each of the sluice-gate prices for these products to the sluice-gate prices for pig carcases.
As regards the products listed in Article 1(1)(c), the levy shall be equal to the sum of the following components:(a)one component derived from the levy on pig carcases on the basis of the ratio within the Community of the prices for such products to the price for pig carcases;
Whereas it is therefore necessary to lay down general rules ensuring uniform grading of pig carcases, particularly in order to guarantee producers fair payment based on the weight and composition of the pigs they have delivered to slaughterhouses;whereas this grading is also intended to make the market more transparent as regards trade in pig carcases;
Whereas, however, in view of the variety of slaughterhouse structures and practices,it is not possible to provide for simultaneous implementation throughout the Community of the new scale for grading pig carcases; whereas it is therefore necessary to allow some Member States to continue, during a transitional period, to apply the method of grading pig carcases laid down in Regulation(EEC) No 2760/75.
Whereas, given the differences in pig production in the Community, pig carcases should be divided according to their lean-meat content into five commercial grades, each covering a range of 5% of lean meat; whereas Member States should nonetheless be given the option of adding an additional grade for carcases with a high percentage of lean meat;
Whereas for the sake of clarity a new regulation combining all the rules on the marketing stage to which the average price for pig carcases refers should be adopted; whereas Commission Regulation(EEC) No 2342/86(10), as amended by Regulation(EEC) No 2847/87(11), should accordingly be repealed;
