Article 8 of the said directive, headed‘Removal', provides.

Article 11 of the said directive is headed‘Entry ban' and reads as follows.

In addition, the provisions on employeeparticipation are reported by companies and legal advisors as more flexible in the said Directive than in the SE Statute, although this is contested by worker organisations.
Whereas textile products may only be placed on the market within the Community if they satisfy the provisions of the said Directive;
Whereas, if Member States have taken the necessary measures to comply with the said Directive, it is not necessary for them to adopt new measures to meet this Directive, provided the measures already taken comply with the latter;
The Agency shall also examine whether these rules enable the CSTs defined by the said Directive to be achieved.
Whereas, in the light of the developments in technical and scientific knowledge,it is appropriate that Annex II to the said Directive be brought up to date by adding to it particulars concerning the pesticide maleic hydrazide, which may well be present as a residue in fruit and vegetables.
Laboratories which do not meet the assessment criteria shall not be considered as laboratories referred to in Article 7 of the said Directive.

Now that new amendments are being made, it is appropriate on the grounds of clarity to repeal the said Directive and replace it by this Directive. .
Whereas Article 16(1)(B) to(E) of the said Directive, taken together in particular with Article 22(9) concerning release from obligations, makes it possible to overcome the difficulties encountered by traders participating in transaction chains involving goods placed and kept under warehousing arrangements;
(1) Article 13(1) of Directive 67/548/EEC exempts certain substances from theprovisions of Articles 7, 8, 14 and 15 of the said Directive, which refer to notification.
Whereas, however, the said Directive does not remove all the barriers to trade in prepackaged products which result from differences in the laws on the metrological properties of such products; whereas, in particular, the Member States have different provisions concerning the volume or weight of such products; whereas such provisions must therefore be approximated;
Whereas adapting Directive 69/169/EEC to the combined nomenclature consequently involves a purely technical amendment which in no way alters the scope of the said Directive.
Whereas, pending the implementation of community rules on the subject,the general principle has been adopted in accordance with article 7 of the said directive that imports from non-member states should not enjoy more favourable conditions than those applying to intra-community trade;
