وفيما تحيط اللجنة علماً بحجة الدولة الطرف بأنه كان بوسع صاحب البلاغ الاعتراض على عدم الحياد المزعوم للقضاة المعنيين بقضيته في الإجراءات المدنية، تلاحظ أيضاً ادعاء صاحب البلاغ، الذي لم يُطعن فيه، بأن المحكمة العليا قد رفضت اعتراضاً مماثلاً تقدَّم به في قضية أخرى، واستنتجت أنالصلة القائمة بين محكمتي لاهاي ومكتب DBB لا تثير شكوكاً موضوعية بشأن استقلال وحياد المحكمتين
