Consideration of the draft Mining Code.
(a) The agenda for the first part of the sessionshall be devoted to consideration by the Council of the draft mining code.
Several delegations suggested that the highest priorityshould be given to completing work on the draft mining code as soon as possible.
First, the draft mining code being developed by the Authority is receiving close and careful scrutiny at the Council stage.
For the purposes of these guidelines, the following terms are to be read andinterpreted in a manner consistent with the draft Mining Code: 3.
Assessed and interpreted results of the monitoring shall be reported to the Authority together with the data according to regulation 28 and annex 4,section 5.4, of the draft Mining Code.
Although some issues remain to be resolved,a number of the provisions of the draft mining code have in effect met with the approval of delegations.
Among the matters considered by the Council during this part of the session were the budget for 1999, the scale of assessments for contributions to the budget,the Financial Regulations of the Authority and the draft mining code.
In addition, the draft Mining Code currently under consideration by the Authority envisages that the Legal and Technical Commission may from time to time issue guidelines for the assessment of potential effects on the marine environment.
With respect to the organization of work for the sixth session of the Authority,priority will be given to the work of the Council on the draft mining code, with a view to adopting the code during 2000.
Decides that, in order to enable the Council to complete its work on the draft mining code during 2000, there should be two two-week sessions of the Authority in 2000, without prejudice to the future work pattern of the Authority;
(b) The agenda for the second part of the session shall include, during the first week of the two-week session, the elections to the organs and offices of the Authority and the workof the Finance Committee and the conclusion and adoption of the draft mining code;
Trinidad and Tobago continues to followclosely the work of the International Seabed Authority on the draft mining code elaborated by the Legal and Technical Commission during the third session of the Authority.
Regulation 28(1) of the draft Mining Code provides that the Authority shall develop procedures for the establishment of environmental baselines against which to assess the likely effects on the marine environment of activities in the Area.
By the end of the tenth session of the Preparatory Commission,Special Commission 3 had completed the first reading of the draft mining code on the basis of the working papers prepared by the Secretariat.
To advance the work of the Council on the draft mining code, the Secretary-General will consult with the incoming President of the Council and with the regional groups and interest groups with a view to identifying the main areas of difficulty in the draft code and the most efficient working method which would enable the outstanding issues to be resolved.
Article 158, paragraph 1, of the draft Mining Code provides that activities in the Area" shall be carried out under such conditions that the workers employed in such activities are afforded adequate protection against discrimination in employment on the grounds of race, colour, sex, religion, political opinion, national extraction or social origin, as well as in the fields of occupational safety and health, labour relations, including freedom of association, conditions of work, social security, employment security and living conditions at the worksite".
We note that the Council of the International Seabed Authority will continue its review of the draft mining code on a priority basis and look forward to substantial progress and the finalization and adoption of the code next year.
This report appraises the progress made to date in Special Commission3 in the consideration of the various documents comprising the draft mining code. It also intends to shed light on the issues that require further consideration.
