In the present code, the following terms shall mean.
في هذه المدونة، يقصد بالمصطلحات التالية ما يلي

The provisions of the present Code shall also apply to the following persons.

A marriage contract ceases to have effect from the moment the marriage is terminated in accordance with article 28 of the present Code.
يتوقف نفاذ عقد الزواج عند انتهائه وفقاً للمادة 28 من هذا القانون

Independent of the present code, all Secretariat staff members are subject to United Nations regulations and standards of conduct, even after termination of the employment contract.

The accused person shall be released if the indictment has not been brought until the expiry of the terms referred to in paragraphs 2 and 3 of the present Code.

Declaration of non-disclosure" means a copy of the declaration set forth in annex II to the present code, signed and dated by the member making the declaration.
يعني" إعلان عدم الإفصاح" نسخة من الإعلان الوارد في المرفق الثاني بهذه المدونة والموقع والمؤرخ بواسطة العضو المقدم للإعلان

Should the registry not take place within 30 days, administrative inscription may be carried out in accordance with the provisions of Book Two, Chapter VI, of the present Code.
فان لم يتم التسجيل في غضون ٠٣ يوما، فمن الجائز القيام بالتسجيل اﻻداري وفقا ﻷحكام الفصل الرابع من الكتاب الثاني من هذا القانون

Place outside the country. The present Code also applies to crimes committed outside the territory of the State for which the Yemeni courts have competence under the Code of Criminal Procedure.".
كما يسري هذا القانون على الجرائم التي تقع خارج إقليم الدولة وتختص المحاكم اليمنية بها وفقاً لقانون الإجراءات الجزائية

(a) Judges must be of high moral character and always, and not only in the discharge of their duties, act honourably and in accordance with the values and principles set out in the present Code;
(أ) على القضاة أن يتحلوا بمكارم الأخلاق، وأن يتصرفوا بنبل بصفة دائمة وليس فقط أثناء اضطلاعهم بمهامهم ووفقا للقيم والمبادئ المنصوص عليها في هذه المدونة

That restrictive approach could be seen in article 1 of the draft Code, which provided that" the present Code applies to the crimes against the peace and security of mankind set out in Part II".

He may issue instructions to law enforcement officers and members of the police force working in penal institutions on the exercise of the powers and functions provided for under the present Code.

According to article 5 of the Penal Code:" The infliction of the penalties prescribed in the present Code shall not affect the obligation of the opposing parties to make restitution and pay compensation.".
تنص المادة 5 منه هذا القانون على أنه:" لا يمس الحكم بالعقوبات المنصوص عليها في هذا القانون ما يكون واجباً للخصوم من الرد والتعويض

Mandate-holders shall be provided by the United Nations High Commissioner for Human Rights, along with the documentation pertaining to their mission, with a copy of the present Code of which they must acknowledge receipt.
يعطي مفوض الأمم المتحدة السامي لحقوق الإنسان أصحاب الولايات، إضافة إلى الوثائق المتعلقة بمهامهم، نسخة من هذه المدونة التي يجب أن يقرّوا باستلامها

Without prejudice to article 54 bis and article 100 of the present Code, no court may hand down a suspended sentence for any of the offences listed in this article or take mitigating factors into consideration.
على الرغم مما ورد في المادتين(54) مكرر و(100) من هذا القانون لا يجوز للمحكمة وقف تنفيذ العقوبة المحكوم بها في الجرائم الواردة في هذه المادة كما لا يجوز لها الاخذ بالاسباب المخففة

(7) The police authorities may seize the objects stated in Paragraph 1 of this Article when proceeding pursuant to the provisions of Article 230 and 246 of the present Code or when executing the judicial warrant.
(7) يجوز لسلطات الشرطة حجز الأشياء المذكورة في الفقرة 1 من هذه المادة عند العمل بمقتضى أحكام المادتين 230 و 246 من هذا القانون أو عند تنفيذ أمر قضائي

The provisions of the present Code apply to all foreigners present in the State of Bahrain who commit while abroad an offence other than those specified in articles 6, 7 and 8 of the present Code and whose extradition has not already been requested.
تسري أحكام هذا القانون على كل أجنبي في دولة البحرين كان قد ارتكب في الخارج جريمة غير منصوص عليها في المواد 6 و7 و8 من هذا القانون ولم يكن طلب تسليمه قد قبل

This is affirmed in article 5 of the Criminal and Penal Code, which states:" The penalties prescribed in the present Code shall be without prejudice to the duty of parties to make restitution and reparation.".
وأكَّدت ذلك المادة 5 من قانون الجرائم والعقوبات بقولها:" لا يمس الحكم بالعقوبات المنصوص عليها في هذا القانون ما يكون واجباً للخصوم من الرد والتعويض

(d) Judges, like other citizens, are entitled to freedom of expression, belief, association and assembly, but must exercise these freedoms with due regard to the values and principles set out in the present Code;
(د) يتمتع القضاة، مثلهم مثل بقية المواطنين، بحرية التعبير والمعتقد والانضمام إلى الجمعيات والتجمع، لكن عليهم ممارسة هذه الحريات مع إيلاء الاعتبار الواجب للقيم والمبادئ المنصوص عليها في هذه المدونة

The precedence given to the EPA methods in the present code is based on the relative comprehensiveness of the methods available(both in scope and content), and the relative ease of access to those methods.

(10) The Committee notes that under the new Personal and Family Code, only monogamous marriage is recognized, and that" custom ceases to have the force of law in all matters covered by the present Code".

(1) The characterization of aggression as a crime against the peace and security of mankind contained in article 16 of the present Code is drawn from the relevant provision of the Nürnberg Charter as interpreted and applied by the Nürnberg Tribunal.
(1) إن وصف العدوان كجريمة مخلة بسلم الإنسانية وأمنها كما يرد في المادة 16 من هذه المدونة مستمد من الأحكام ذات الصلة لميثاق نورمبرغ حسبما فسرتها وطبقتها محكمة نورمبرغ

Article 137 of the Labour Code indeed provides that:" For work of equal value, pay shall be equal for all employees, regardless of their origin, sex, age, status and faith, under the conditions provided for in the present Code.".
وبالفعل، تنص المادة 137 من قانون العمل على ما يلي:" يتساوى الأجر عن العمل المتساوي القيمة لكل العاملين أياً يكن أصلهم وجنسهم وعمرهم ومركزهم ودينهم، وفقا للشروط المنصوص عليها في هذا القانون

Notwithstanding the provisions of article 54 bis and article 100 of the present Code, the courts may not suspend a sentence handed down for the offences listed in the present article, nor may they take mitigating factors into consideration.".

The provisions of the present Code complement those of the Regulations Governing the Status, Basic Rights and Duties of Officials other than Secretariat Officials, and Experts on Mission(ST/SGB/2002/9)(hereinafter referred to as" the Regulations");
تتكامل أحكام هذه المدونة تكاملاً متبادلاً مع أحكام النظام الأساسي الذي ينظم مركز المسؤولين بخلاف موظفي الأمانة العامة والخبراء القائمين بمهمة وحقوقهم وواجباتهم الأساسية(ST/SGB/2002/9)(يشار إليه فيما يلي بعبارة" النظام الأساسي")

(2) Unless otherwise prescribed by the provisions of this Chapter, in the proceedings of temporary confiscation of objects and property gain referred to in Article 1 of the present Code, the provisions of the Law on Executive Proceedings as well as relevant provisions of the present Code shall be applied accordingly.

Having due regard to article 251 of the present Code, a term of up to 10 years ' imprisonment shall be imposed on anyone who abducts a newborn child and a term of up to 7 years ' imprisonment shall be imposed on anyone who conceals or swaps a child for another or who makes a fraudulent claim regarding the parentage of a child.

How to use "the present code" in a sentence

The present code supports the following Operating Systems.

The corresponding provision of the present Code is § 102(a).

The present code cannot distinguish left and right circular polarization.

The present code does not strictly prohibit such an installation.
