Development of Network Codes;

Development of Network Codes.
Energy: Establishment of the annual priority lists for the development of network codes and guidelines for 2017 and beyond.
The European Commission, after consulting ACER, ENTSOs and the other relevant stakeholders,establishes an annual priority list identifying the areas to be included in the development of network codes.
The proposed regulation gives ACER a stronger role in the development of network codes and the coordination of regional decision-making.
Participating in the development of network codes which are relevant to the operation and planning of distribution grids and the coordinated operation of the transmission networks and distribution networks pursuant to Article 59.
The Commission shall, after consulting the Agency, the ENTSO for Gas and the other relevant stakeholders establish an annual priority list identifying the areas set out in Article 8(6)to be included in the development of network codes.
The European Commission can then request ACER to submit to it within six months a non-binding framework guideline(framework guideline), setting out clear andobjective principles, for the development of network codes relating to the areas identified in the priority list.
The Commission shall, after consulting ACER, the ENTSO for Electricity, the EU DSO entity and the other relevant stakeholders, establish a priority list every three years, identifying the areas set out in paragraphs 1 and2 to be included in the development of network codes.
The Commission shall request ACER to submit to it within a reasonable period not exceeding six months of receipt of the Commission's request non-binding framework guidelines setting out clear andobjective principles for the development of network codes relating to the areas identified in the priority list(framework guideline).
The Commission shall, after consulting the Agency, the ENTSO for Electricity, the EU DSO entity for electricity and the other relevant stakeholders, establish a priority list every three years,identifying the areas set out in paragraph 1 to be included in the development of network codes.

The proposal also includes a formal place for DSOs to be represented at EU level,notably in the development of network code proposals, in line with an increase in their responsibilities.

Advancing the internal energy market in electricity and gas,notably by the development and implementation of Network Codes and Guidelines; and by providing opinions and guidance to relevant players as required.

(62) Experience with the development and adoption of network codes has shown that it is useful to streamline the development procedure by clarifying that ACER has the right to revise draft electricity network codes before submitting them to the Commission.
By 31 October 2023, and every three years thereafter,the Commission shall submit a report to the European Parliament and to the Council on ACER's involvement in the development and adoption of terms and conditions or methodologies for the implementation of network codes and guidelines adopted as delegated acts after 4 July 2019.
Where one of the following legal acts provides for the development of proposals for terms and conditions or methodologies for the implementation of network codes and guidelines which require the approval of all the regulatory authorities of the region concerned, those regulatory authorities shall agree unanimously on the common terms and conditions or methodologies to be approved by each of those regulatory authorities.
Where one of the following legal acts provides for the development of proposals for common terms and conditions or methodologies for the implementation of network codes and guidelines which require the approval of all regulatory authorities, those proposals for common terms and conditions or methodologies shall be submitted to ACER for revision and approval.
The Commission's proposal under Article 5(2) provides for the development of proposals for terms and conditions or methodologies for the implementation of network codes and guidelines, which require regulatory approval by all regulatory authorities or by all regulators of the concerned region, to be submitted for revision and approval to the Agency.
All documents andminutes of consultation meetings conducted during the development of framework guidelines in accordance with Article 59 of Regulation(EU) 2019/943 or Article 6 of Regulation(EC) No 715/2009, or during the amendment of network codes referred to in paragraph 1 shall be made public.
Coordinate the development of all network codes for the relevant transmission system operators and other market actors; and.
(d) coordinate the development of all network codes and guidelines for the relevant transmission system operators and other market actors; and.
It also includes the European entity for DSOs andother stakeholders more closely in the procedure of the development of proposals for electricity network codes.
That development has been supported by the adoption of several network codes and guidelines for the integration of the electricity markets.
While participating in the development of new network codes pursuant to Article 59, the EU DSO entity shall conduct an extensive consultation process, at an early stage and in an open and transparent manner, involving all relevant stakeholders, and, in particular, organisations representing such stakeholders, in accordance with the rules of procedure on consultation referred to in Article 53.
