One exporting producer argued that the normal value for one product type should have been based on domestic price rather than constructed value.
Investigations involving constructed value shall be concluded within one year of their initiation or within one year of delivery of the vessel, whichever is the later.
Article 2(7)(a) of the basic Regulation provides that the normal value is determined on the basis of the price or constructed value in a market economy third country, in this case the USA.
In the case of imports from non-market economy countries(*),normal value shall be determined on the basis of the price or constructed value in a market economy third country, or the price from such a third country to other countries, including the Community, or where those are not possible, on any other reasonable basis, including the price actually paid or payable in the Community for the like product, duly adjusted if necessary to include a reasonable profit margin.

Whereas Article 2(7) of Regulation(EC) No 384/96 lays down that, in the case of imports from non-market economy countries and, in particular those countries to which Regulation(EC) No 519/94 applies,normal value shall be determined on the basis of the price or constructed value in an analogue market economy third country;
Pursuant to Article 2(7)(b) of the basic Regulation, normal value in the PRC andRussia is determined on the basis of the prices or constructed value of those producers which can demonstrate that they meet the criteria laid down in the said Article 2(7)(c), i.e. that they operate under market economy conditions.
Article 2(7) of Regulation(EC) No 384/96 lays down that, in the case of imports from non-market-economy countries and, in particular, those listed in a footnote to that provision, normal value shall, inter alia,be determined on the basis of the price or constructed value in an analogous market-economy third country.
For all other producers in the same country, normal value is determined on the basis of Article 2(7)(a),i.e. on the basis of a price or constructed value in a market economy third country, or on any other reasonable basis foreseen in Article 2(7)a.
Article 2(7)(a) of the basic Regulation provides that in the case of imports fromcountries such as Russia, normal values be established on the basis of the price or constructed value in a market economy third country unless an exporting producer meets the criteria set out in subparagraph(c) of the aforementioned provision.
Article 2(7) of Council Regulation(EC) No 384/96("basic Regulation") provides that in the case of imports from countries like the PRC,the normal values are to be established on the basis of the price or constructed value in a market economy third country unless an exporting producer meets the criteria set out in subparagraph(c) of paragraph 7 of that Article.

The constructed normal value was therefore recalculated taking into account this element.
Determination of the constructed normal value first and second pleas in law.
In the absence of any other reasonable method, constructed normal value was used.
Therefore, the claims concerning the profit margin used to determine constructed normal value were rejected.
The exporting producers asserted that the constructed normal value is too high to be considered reasonable.
Since import dutiesare reimbursed upon export, the Council deducted them from the constructed normal value.

Article 2(3)(b)(ii) of the basic regulation also confers a wide discretion on the institutions in assessing accounting data submitted to them for the purposes of determining constructed normal value.
These exporting producers claimed that the company-wide profit margin during the investigation period, i.e. a global figure including both the product concerned and other products,should be used to determine the constructed normal value.
For one exporting producer, normal value was entirely based on domestic prices andfor another exporting producer entirely on constructed normal value.
