By judgment of 28 February 1994, received at the Court on 16 March 1994, the Tribunal de Grande Instance(Regional Court), Paris,referred to the Court for a preliminary ruling a question on the interpretation of Commission Directive 88/301/EEC of 16 May 1988 on competition in the markets in telecommunications terminal equipment for the purpose of assessing the compatibility with that directive of the typeapproval procedure for telecommunications equipment laid down by the French legislation.
However, the Commission will contact the relevant French authorities to check the conditions for the typeapproval of this kind of equipment and will of course take any appropriate measure if need be, in accordance with Article 30 of the EEC Treaty which forbids any quantitative restrictions or measures having equivalent effect which might hinder intra-Community trade.
Procedure for granting component type-approval:- the application for component typeapproval is submitted by the manufacturer to the competent authority within a Member State;- the competent authority grants component typeapproval for the protective devices if these conform to the technical requirements of this Directive and to the data provided by the manufacturer;- to this end this authority fills in the component typeapproval certificate contained in the annex to the Directive. 10.
