The Commission accepts the SCHER Opinion of 18 March 2005 that, despite limitations in the available methodology for testing these entities,the data so far available indicate PFOS to be very persistent, very bio-accumulative and potentially toxic and that risk reduction measures are justified to prevent any recurrence of wide-scale use.

With regard to the derogations contained in the proposal, I agree that the use of PFOS and related substances should continue to be permitted in photoresists and photographic materials, when plating with hexavalent chromium and other metals, and in hydraulic fluids, as the risks connected with these uses are acceptable since there are no equivalent alternatives and it is not certain that the toxicological profiles of the alternatives are any better.
May not be place on the market in semi-finished products or articles, or parts thereof, if the concentration of PFOS is equal to or higher than 0.1% by mass calculated with reference to the mass of structurally or micro-structurally distinct parts that contain PFOS or, for textiles or other coated materials, if the amount of PFOS is equal to or higher than 1 µ g/m² of the coated material.
