Having concluded that the public intervention in question ranks as state aid, the Commission has taken the view that it is incompatible with the common market since Cockerill is a steel firm subject to thevery restrictive rules of the ECSC Treaty and the steel aid code, which does not provide for such aid. .
With regard to the scope of Article 67 CS, I am of the opinion that it covers all measures which serve to compensate for the harmful effects suffered by steel undertakings as result of rules of general economic policy, with the exception of State aid the conditions for the grant of which are specifically governed by Article 4(c)CS and by the steel aid codes.
