The following operating rules do not form any part of the assessment of the structural subsystems.
These structural subsystems are considered to be interoperable only if they are accompanied by an“CE” declaration of verification.
Member States shall consider as being interoperable and meeting the essential requirements concerning them those structural subsystems constituting the trans-European high-speed rail system which are covered by the EC declaration of verification.
The structural subsystems constituting the rail system which are covered by the«EC» declaration of verification are considered as being interoperable and meeting the essential requirements.
Each Member State shall authorise the placing in service of those structural subsystems constituting the trans-European high-speed rail system which are located or operated in its territory.
In addition to serious accidents, may carry out investigations on accidents and incidents which under slightly different circumstances, could lead to serious accidents,including technical failures at the level of the structural subsystems or high-speed rail or conventional system interoperability constituents.
As far as they are not yet covered by TSIs,methods to check that the structural subsystems of the trans-European high-speed and conventional rail systems are operated and maintained in accordance with the relevant essential requirements.
That said, however,all governments should avoid reducing the scope of the meaning of interoperability to such an extent that it relates only to the technical capacity of structural subsystems in a way which gives priority to preserving existing national networks.
Each Member State shall authorise the placing in service of those structural subsystems constituting the trans-European conventional rail system which are located in its territory or operated by railway undertakings established there.
Without prejudice to Article 19, Member States may not, in their territory and on grounds of this Directive, prohibit, restrict or hinder the construction,placing in service and operation of structural subsystems constituting the trans-European high-speed rail system which satisfy the essential requirements.
The rail system is subdivided into structural subsystems(infrastructure, energy, control-command and signalling, rolling stock) and into functional subsystems(traffic operation and management, maintenance, telematic applications etc.).
Accidents and incidents which under slightly different circumstances, could lead to serious accidents,including technical failures at the level of the structural subsystems or of interoperability constituents of the trans-European high-speed or conventional rail system;
The structural subsystems constituting the rail system are subjected to a verification procedure, which enable the National Safety Authority(Department of Railway Safety) responsible for authorising their placing in service to be certain that, at the design, construction and putting into service stages, the result is in line with the regulations and technical and operational provisions in force.

Railway undertakings, infrastructure managers and any actor referred to in paragraph 4 who identifies or is informed of a safety risk relating to defects and construction non-conformities or malfunctions of technical equipment,including those of structural subsystems, shall, within the limits of their respective competence.

The Agency andthe national safety authorities shall consider as meeting the essential requirements, those structural subsystems constituting the rail system which are covered, as appropriate, by the‘EC' declaration of verification established by reference to TSIs, in accordance with Article 15, or the declaration of verification established by reference to national rules in accordance with Article 15(8), or both.
