The State of export shall not allow the generator or exporter to commence the transboundary movement until it has received written confirmation that.

Hence in my opinion the Court does not have sufficient facts to assess whether recourse to the simplified procedure for image storage media that havealready been examined and classified in the Member State of export would be an appropriate way of achieving the level of protection of young persons that the German authorities seek to provide in Germany.
