Our interpretation of Article 290 is that this gives the Commission the opportunity to supplement or amend legislation.
Where a legislative act delegates to the Commission the power to supplement or amend certain non-essential elements of a legislative act, the committee responsible.
In order to supplement or amend certain non-essential elements of this Regulation, the power to adopt acts in accordance with Article 290 of the Treaty should be delegated to the Commission.
Article 290 TFEU gives the Commission the power to supplement or amend certain non-essential elements of its rules.
In order to supplement or amend certain non-essential elements of this Regulation, the power to adopt delegated acts in accordance with Article 290 of the Treaty should be delegated to the Commission.
In accordance with Article 290 of the Treaty the Commission may be empowered to supplement or amend non-essential elements of a legislative act by means of delegated acts.

Furthermore, following the entry into force of the Treaty of Lisbon,the provisions of Regulation(EC) No 648/2004 concerning the power of the Commission to adopt non-legislative acts of general application to supplement or amend certain non-legislative elements of that Regulation have to be adapted to the requirements of Article 290 of the Treaty on the Functioning of the European Union.
The Commission should be empowered to adopt delegated acts in accordance with Article 290 of the Treaty in respect of road safety(including braking), occupational safety and environmental performance, testing, access to repair and maintenance information and appointment andspecific authorized tasks of technical services, in order to supplement or amend certain non-essential elements of this Regulation.
In areas where the Commission is currently empowered by Directive 2009/138/EC to adopt implementing measures where these measures are non-legislative acts of general application to supplement or amend certain non-essential elements of that Directive in the sense of Article 290 TFEU, the Commission should be empowered to adopt delegated acts in accordance with that Article.

The Treaty of Lisbon, which entered into force on 1 December 2009,makes a distinction between the power conferred on the Commission to adopt non-legislative acts of general application to supplement or amend certain non-essential elements of a legislative act under Article 290 TFEU(delegation procedure), and the power to adopt implementing acts under Article 291 TFEU implementing procedure.
Article 290 of the Treaty on the Functioning of the European Union states that a legislative act may delegate to the Commission the power to adopt non-legislative acts of general application to supplement or amend certain non-essential elements of the legislative act.
