In February, ANEM reached with OFPS andPI an agreement on the single tariff for the fees for broadcasting phonograms and interpretations recorded on them. This has marked the successful completion of the negotiations that were conducted since October 2013, as well as the introduction of a new tariff for the first time since 2009.
A correct recording system is the only way to charge fees realistically,because only in that case can it be estimated how many phonograms the user actually used.
Additionally, the Law stipulates that the fee for the public communication of music works,interpretations and phonograms will be charged by one organization only- the one protecting the rights of authors- while the funds that organization will collect shall be allocated according to the agreement reached between the collective organizations.
In practice, this will impose an additional obligation on the media to record andadministrate data related to broadcast music pieces, phonograms and interpretations.
Namely, citing the provision of Article 183 of the current Law,the media- primarily in litigation against the collective organization representing producers of phonograms(OFPS)- emphasized that OFPS requests related to the submission of data concerning broadcast phonograms in the media exceeded the framework regulated by law.
The court found that the station in question failed, in January, February, March, April, May, June and July 2010, to furnish the Organization of Phonogram Producers of Serbia(OFPS)with the log of used LEGAL MONITORING OF SERBIAN MEDIA SCENE- Report for January/February 2011 phonograms.

Three main topics discussed at this workshop were: Implementation of the Advertising Law- with special reference to the rules on political advertising; Media Strategy and changes in the process of digitalization; the application of the Law on Copyright and Related Rights- tariffs of collective organizations andlists of broadcast musical works and phonograms.
As a problem, he also mentioned disturbed relations between broadcasters and collective organizations for the protection of copyright and related rights. Slobodan Kremenjak, ANEM lawyer, talked about the last decision of the Commission on Copyright and Related Rights, namely the decision brought after the failure of re-negotiations of SOKOJ and ANEM as the representative association of broadcasters.
By the latter we mean the failure of the Government of the Republic of Serbia to finally appoint the members of the Copyright and Related Rights Commission andenable the implementation of the new mechanism for determining the tariffs of the fees for the use of authors' musical works and phonograms in the program of broadcasters.
Stations were also informed about benefits, obligations and costs they could expect in this process, and advised to postpone the procurement of equipment, given that the process had been delayed. The third topic of the workshop was related to the implementation of the Law on Copyright and Related Rights,with special reference to the tariffs of collective organizations and lists of broadcast musical works and phonograms.
Also, the proposed amendment to Article 183 of the Law, regulating the obligations of users- and inherently the media- to collective organizations for the protection of copyright and related rights,provides for grounds to authorize collective organizations to expand the scope of their requests for the submission of lists of broadcast works of art, phonograms and interpretations.
Annex to the Agreement on a single tariff of fees, and Protocol with OFPS and PIFollowing the adoption of new media legislation, the Law on Public Information and Media and the Law on Electronic Media, as well as amendments to the regulations in the field of accounting and auditing, ANEM, OFPS andPI have agreed to conclude an Annex to the Agreement on a single tariff of fees for broadcasting phonograms and interpretations recorded on them.
OFPS is working on new software which will enable easier registering of phonogram usage.

In practice, performers have typically concluded agreements with phonogram producers, to which they have assigned the right to their part of fee.
In line with this directive, the term of protection for performers and phonogram producers has been extended from 50 to 70 years.
Namely, according to the said Law, the phonogram producers' fee for broadcasting, rebroadcasting and public communication, as well as the performers' fee for broadcasting, rebroadcasting and public communication, is to be charged as a single fee.
Phonogram producer- a natural person or legal entity who by its own initiative and responsibility is the first one to make the fixation of sounds or any performance or other sounds as well as other sound expressions.
Copy of a phonogram-a copy of a phonogram in any tangible medium, made directly or indirectly from a phonogram and which includes all or part of the sounds of the sounds fixed in that phonogram. .
