He said that both collective organizations and ANEM, as the representative association of broadcasters as users, had fulfilled their obligations stipulated by the new Law.
In this procedure before the Commission for Copyright and Related Rights for the obtaining of opinion onthe SOKOJ's proposed tariff, ANEM has acted as a representative association of broadcasters- users of musical works.
Since ANEM was acting on behalf of not only its members,but also as a representative association of broadcasters, the agreed discounts and benefits will be available to other radio and TV stations under same conditions.
Instead of clarifying things, the legislators opted for an even vaguer criterion,which may only complicate further the odds of reaching an agreement between collective organizations and the representative association of users.
The way of determining tariffs of collective organizations were discussed and stations were informed about the activities of ANEM as the representative association of broadcasters participating in the negotiations on tariff of collective organizations, as well as about the progress in these proceedings.
The Law stipulates that the tariffs related to the fees paid to collective organizationsshall be established in a form of an agreement between collective organizations, on the one side, and representative associations of users, on the other side.
In a statement released on September 12, Sokoj informed the public that cooperation protocols with the representative associations of users- the Employers Union,the Information Activities Union and ANEM, as the representative association of broadcasters, were signed.
The Law also stipulates that the Tariff for both types of fees shall be determined in a unified way, in a written agreement between the Phonogram Producers Organization andthe Performers Association from one side and the representative association of users from the other side.
ANEM, as a representative association of users- radio and television broadcasters, has been participating in negotiations with SOKOJ, OFPS and PI, as the only three organizations licensed by the Intellectual Property Office to perform collective management of copyright and related rights, but the negotiations have not resulted in an agreement on tariffs.
According to the concept adopted in the new Law,the level of Tariffs shall be agreed upon in negotiations between the organization and the representative association of users and shall come in the form of a written agreement.
Mirkovic stressed that in the procedure of determining the tariffs by the new Law,ANEM had been recognized as the representative association of broadcasters, as one of the users and that negotiations with neither SOKOJ, nor OFPS and PI, had resulted in the agreement, and as the Commission had not been appointed yet, it was impossible to definitely determine new tariffs.
The second major change relevant for the media landscape is the change to Article 170, paragraph 5 of the Law on Copyright and Related Rights,namely the change to the criteria for determining the tariffs implemented by collective organizations in the negotiations with the representative association of users.
We remind that a tariff dispute is still going on before the Commission,between LEGAL MONITORING OF SERBIAN MEDIA SCENE-Report for January- February 2012 ANEM, as the representative association of broadcasters and OFPS, the collective organization for the protection of phonogram producers' related rights.
After lengthy negotiations,ANEM(as the representative association of broadcasters- users of copyrighted music works) reached with SOKOJ an arrangement about a Cooperation Protocol. Under that Protocol, substantial discounts and benefits for broadcasters were provided from the existing tariffs, in relation to paying the minimum fee for the use of copyrighted music works.
The delay was caused, on one hand, due to the feet dragging of the Government in appointing the Comission for Copyright and Related Rights and, on the other, the slow work of the Commission which, althout it was established late last year,has only now called the representative association of users to submit an opinion about the proposed tariff.
We remind that the Law on Copyright andRelated Rights stipulates that these tariffs will be determined by mutual agreement with the representative association of users and that, if no agreement is reached, the proposed tariffs shall be set by the managing board of the collective organization and sent to the Commission for Copyright and Related Rights for opinion.
The reason for reopening negotiations lies in the fact that the Commission on Copyright and Related Rights has given a negative opinion on the SOKOJ's proposal of the tariff in part related to broadcasters andhas instructed SOKOJ to repeat the negotiations with the representative association of users within the legal term, or submit a new proposal of the tariff.
After lengthy negotiations,ANEM(as the representative association of broadcasters- users of LEGAL MONITORING OF THE SERBIAN MEDIA SCENE-Report No. 52, for May 2014 copyrighted music works) reached with SOKOJ an arrangement about a Cooperation Protocol. Under that Protocol, substantial discounts and benefits for broadcasters were provided from the existing tariffs, in relation to paying the minimum fee for the use of copyrighted music works.
In addition, the Association requested a deferral of putting Commission's opinion in effect until the passing of a court decision, in order to prevent the entry of new tariff of SOKOJ into force. By adopting such Opinion,the Commission has concluded long-term tariff dispute that ANEM, as a representative association of broadcasters, led with SOKOJ regarding the tariff of fees.
ANEM AND SOKOJ SIGNED THE PROTOCOL ON COOPERATIONAfter many months of negotiations,ANEM, as a representative association of broadcasters- users of musical works, has signed with SOKOJ a Protocol on cooperation, which provides broadcasters with substantial discounts and benefits for payment of the minimum fees for usage of musical works, for the period March 1- December 31, 2012.
We remind that in July 2012, in its address to the Government of the Republic of Serbia, the competent Ministry of Education and Science and the Intellectual Property Office, ANEM was the first to propose a concept of transferring competence of the Commission onto the Intellectual Property Office. Hence,that part of the Amendments may be credited to endeavors of ANEM as a representative association of broadcasters.
In the course of the public debate, in proposals and comments,ANEM has insisted on specifying the mechanisms based on which the attribute of a particular association as the representative association of beneficiaries would be determined, as well on enabling the beneficiaries' associations to have their representatives in the Copyright and Related Rights Commission.
The existence of comparative tariffs may only help to settle potential tariff disputes in the future, by providing exact data and avoid the tariffs to be based on some vague categories(as it is currently the case) such as"mainly generally accepted standards", invoked by the SerbianCommission for Copyright and Related Rights in the tariff dispute between Sokoj and ANEM, as the representative association of broadcasters, in December last year.
The procedure is currently in the phase of obtaining opinion of the Commission on the Proposal of a unique tariff, supplied by the managing boards of these collective organizations based on written agreement.In that procedure, ANEM, as a representative association of broadcasters- users of their protected objects, was recently asked to provide its opinion on the Proposal in writing, following which, the Commission would give its opinion.
LEGAL MONITORING OF SERBIAN MEDIA SCENE- Report for May 2011 4.COMMISSION FOR COPYRIGHT AND RELATED RIGHTS In early May, ANEM, as a representative association of broadcasters users of musical author works, received the conclusion sent by SOKOJ, the organization of musical authors of Serbia that had asked ANEM to state its written opinion about SOKOJ's Proposal of the tariff of fees.
Namely, the new Law on Copyright and Related Rights, which came into force on December 24, 2009, stipulates the establishment of the Commission as a professional body authorized for giving opinions on the tariffs' proposals of the collective organizations for copyright and related rights,in cases when negotiations between the organizations and the representative associations of the users of objects of their protection do not result in a written agreement on tariffs.
Namely, ANEM requested that the column" Partner", for all specified activities in the Action Plan,should include that these activities shall be performed in consultations with national broadcasters and ANEM, as the representative association of broadcasters, which gathers one national broadcaster and regional and local broadcasters across Serbia. ANEM pointed out that these activities were of a great importance for broadcasters who therefore ought to be involved in their implementation.
PROTOCOL ON COOPERATION BETWEEN ANEM AND SOKOJAs a representative association of broadcasters- users of musical copyright works, ANEM has today, after lengthy negotiations, achieved with SOKOJ an agreement on the Protocol on Cooperation, which in comparison with previous protocols of 2012 and 2013 contains significant innovations. Specifically, the Protocol on Cooperation envisages the establishment of a joint expert committee consisting of representatives of ANEM and SOKOJ, whose task is to prepare the conditions for starting new tariff negotiations.
As a problem, he also mentioned disturbed relations between broadcasters and collective organizations for the protection of copyright and related rights. He particularly addressed the issue of tariffs and the obligations of broadcasters to submit lists of broadcast musical works and phonograms to these organizations. Slobodan Kremenjak, ANEM lawyer, talked about the last decision of the Commission on Copyright andRelated Rights, namely the decision brought after the failure of re-negotiations of SOKOJ and ANEM as the representative association of broadcasters.
